1. The present appeal is filed at the instance of original
claimant under Section 173 of the Motor Vehicles Act, 1988,
being aggrieved and dissatisfied with the judgment and award
dated 18th June, 2014 passed by the Motor Accident Claims
Tribunal (Main), Banaskantha District Palanpur, in Motor
Accident Claim Petition no.57 of 2013. By the said judgment,
though the Tribunal has partly allowed the claim petition
preferred by the original claimant under Section 166 of the

Act of 1988, holding him entitled to seek recovery of sum of
Rs.3,99,400/- from the original opponent nos.1 and 2, jointly
and severally with simple interest at the rate of 9% per annum
from the date of filing of the claim petition, i.e. 27 th February,
2013 till its realization, however, has not allowed the claim of
entire amount of Rs.10,00,000/- towards compensation.
Hence, the present appeal for enhancement of the amount of
compensation.
