2. An F.I.R. came to be lodged by
respondent no. 2 alleging, inter alia, that
the marriage between applicant no. 3
and respondent no. 2 was solemnized on
15.10.2021. It is averred that
subsequent to the marriage, matrimonial
discord arose between the parties and
their relations became strained. It is
further alleged that since 15.11.2023,
the applicants have subjected her to
physical assault and mental cruelty.
3. Learned State Counsel submits that
the F.I.R. was initially registered under
Section 323, 498-A, 504, 506 I.P.C. and
Section 3/4 of Dowry Prohibition Act.
However, upon medical examination of
respondent no. 2, a fracture of the nasal
bone was detected, and accordingly,
offences under Section 325 of I.P.C.
were also invoked.
4. A bare perusal of the F.I.R. would
indicate that no specific or distinct
allegations of physical assault have been
attributed to applicant nos. 1 and 2, who
are the mother-in-law and father-in-law
of respondent no. 2, respectively.
5. Issue notice to respondent no.2,
returnable at an early date.
6. List after service report is received.
By that time, counter affidavit, if any, be
filed.
7. Considering the submission
advanced by learned counsel for the
applicant, it is directed that, till the next
date of listing, further proceedings of
Criminal Case No.5 of 2026 pending in
the Court of learned Additional Chief
Judicial Magistrate, Vikas Nagar,
Dehradun, shall remain stayed, qua
applicant nos.1 & 2.
8. Stay application (I.A. No.1 of 2026)
stands disposed of.
