Heard learned counsel for the petitioners.
2. By this petition, the petitioner No. 1(accused) and the
petitioner No. 2 (victim) seek quashing of the FIR registered with
the Madanrting Police Station being P.S. Case No. 15 (2) of 2021
as against the petitioner No. 1 under Sections 4, 6 and 17 of the
POCSO Act, 2012.
3. At the relevant time, the petitioner No. 2 was 15 years of
age and the respondent No. 2 was 27 years of age. It is stated by
the parties that they were in a consensual relationship and that
they are living together as husband and wife and have three
children from the said relationship. According to the petitioner
No. 2, she never intended to lodge any police complaint/FIR but
it was the villagers who filed the FIR. The petitioners in the

petition stated that they are taking care of the three minor
children and that the petitioner No. 2 has ‘no objection’ to the
quashing of the proceeding as against the petitioner No. 1 in the
backdrop that the relationship was consensual and that they
have three children from the said relationship.
4. Stand over to 7th May, 2026.
5. In the meantime, learned AAG to submit a report from the
concerned Police Station whether what is stated in the petition
is correct and the report be submitted to that effect on the next
date. The petitioner to also appear before the Secretary, High
Court Legal Services Committee within two weeks, so as to
enable the Secretary, High Court Legal Services Committee to
submit her report whether the consent given by the petitioner
No. 2 is an informed consent and whether what is stated in the
petition is correct. The Secretary, High Court Legal Services
Committee to also find out whether the petitioner No. 2 has
received any benefit from any schemes under the State
Government or Central Government. A report to that effect to be
submitted on next date.

6. In the meantime, till the next date, the proceeding before
the trial court is stayed.
