A key development has emerged in the ongoing dispute over the Bhojshala–Kamal Maula complex, with the Madhya Pradesh High Court deciding to undertake a site visit to better understand the factual matrix surrounding the contested structure.
The matter is being heard by a Bench comprising Justice Vijay Kumar Shukla and Justice Alok Awasthy, which is dealing with a batch of petitions concerning the nature and status of the site located in Dhar. In an effort to gain a clearer and first-hand perspective, the Bench scheduled a visit to the premises ahead of further hearings.
The Bhojshala complex has been the subject of longstanding and sensitive claims from different communities. While one side asserts that the site is a temple dedicated to Goddess Vagdevi, another maintains that it functions as the Kamal Maula mosque. Given the competing narratives, the site is currently governed by a regulated arrangement permitting religious practices by different groups on designated days.
The Court’s decision to conduct a physical inspection assumes importance in light of the material already on record, including findings from a detailed survey conducted by the Archaeological Survey of India. The survey, which forms a significant part of the evidentiary record, has been relied upon by the parties to support their respective claims.
By opting to personally inspect the premises, the Bench has indicated its intention to move beyond written submissions and develop a direct understanding of the architectural and structural features of the site. Such an exercise is expected to assist in assessing the competing claims with greater clarity and precision.
The visit is also aimed at facilitating a more informed adjudication in the forthcoming hearings, where arguments from all stakeholders, including intervenors, are likely to be considered in detail. The dispute, given its historical and religious dimensions, continues to attract considerable attention, and the Court’s approach reflects a cautious and fact-driven effort to address the issues involved.
