Bar Council of India Withdraws 3-Year Moratorium on Starting New Law Colleges Nationwide

The Bar Council of India informed the Supreme Court of India that it has withdrawn its earlier decision imposing a three-year moratorium on the establishment of new law colleges across the country.

The submission was made during the hearing of a writ petition filed by the Vocational Education Foundation Society challenging the BCI’s 2025 notification, which had prohibited the opening of new law institutions for a period of three years.

Appearing for the BCI, Advocate Radhika Gautam informed a Bench comprising Justice Vikram Nath and Justice Sandeep Mehta that the moratorium had since been withdrawn.

In view of the statement made by the BCI, the Court disposed of the petition and granted liberty to the petitioner to apply for approval to establish a new law college for the academic session 2025-26.

Apart from the Vocational Education Foundation Society, a separate writ petition was also filed by Jatin Sharma in Jatin Sharma v. Bar Council of India & Ors., Writ Petition (Civil) No. 799/2025, challenging the BCI’s decision to impose the moratorium on new law colleges.
