2. This first bail application has been
moved by the applicant seeking regular
bail in F.I.R./Case Crime No.315 of 2024,
under Section 409, 420 & 120-B I.P.C.
and Section 3 of Uttarakhand Protection
of Interests of Depositors (In Financial
Establishments) Act, 2005, registered at
P.S. Transit Camp, District Udham Singh
Nagar.

3. Learned counsel for the applicant
submits that applicant has falsely been
implicated in the instant crime and is
languishing in jail since 10.07.2024. It is
contended by learned counsel for the
applicant that co-accused, namely,
Sameer Kumar alias Sameer Kumar
Srivastava has already been granted
anticipatory bail by Coordinate Bench of
this Court in ABA No.1212 of 2024 vide
order dated 05.12.2024. He submits that
in case, the applicant is granted bail, he
will not misuse the same and will furnish
the bail surety as per the satisfaction of
this Court.

4. Learned State Counsel has
vehemently opposed the prayer for bail.

5. Considering the submission of
learned counsel for the parties and
without expressing any opinion as to the
2024:UHC:9721

final merits of the case, this Court is of
the view that applicant deserves bail at
this stage.

6. The bail application is allowed.

7. Let the applicant, namely, Gyanesh
Pathak be released on bail, on executing
personal bond and furnishing two reliable
sureties, each of like amount, to the
satisfaction of Court concerned.
