This is a petition seeking quashing of the proceeding under

SPONSORED

the POCSO Act, 2012 with the consent of the parties i.e., the

consent of the petitioner and the respondent No. 5. Quashing is

sought on the premise that the parties are living together as

husband and wife and have a child from the said relationship.

2. The respondent No. 5 is present in person. She states that

she has ‘no objection’ to the quashing of the proceeding. She has

filed an affidavit to that effect and when questioned, she

reiterates what is stated by her in the affidavit. In any event, it

would be appropriate to direct the parties to appear before the

Secretary, High Court Legal Services Committee to enable her to

find out whether the consent is an informed consent; whether

the respondent No. 5 has received any benefits for herself and

the child either from the State or Central Government; whether

the respondent No. 5 wants to pursue her education, any

vocational skill, training programme etc., The said report to be

placed before this Court on the next date.

3. Stand over to 27th April, 2026.

4. Interim relief granted earlier, to continue till the next date.
