1. Heard Sri Alok Kumar, learned counsel for the plaintiff-petitioner.

The case of the plaintiff-petitioner is that against the order dated 14.11.2014 passed in Case No.136 of 2005, Harish Chandra Memorial Junior High School vs. Pramila Rao and others, an appeal came to be preferred by the petitioner herein before the Court of District Judge, Bijnor in Appeal No.82 of 2024. An application under Order 41 Rule 27 read with Section 151 CPC came to be preferred, with on 22.03.2024 being Application No.Ga-255. Objection was raised that the said application was not maintainable while filing written objection. The said application came to be allowed on 19.09.2024 by the Court of Addl. District Judge, Court No.3, Bijnor in Civil Appeal no. 82 of 2015, Akhilesh Chandra vs. Harish Chandra. As per the writ petitioner, one Krishna Pratap Singh also instituted a Civil Suit against a gift deed dated 06.10.1960 being O.S.1130 of 2024, Krishna Pratap Singh vs. Harish Chandra Smarak Inter College. A transfer application also came to be preferred under Section 24 of CPC on 03.12.2025 against which an objection was also preferred, however, on 31.01.2024, an order came to be passed by the Court of Addl. District Judge, Bijnor on Civil Appeal no. 82 of 2024 striking of the defence and the right to cross-examine with relation to the adducing of evidence with respect to the will deed dated 30.11.2024. A recall application was preferred in the month of February 2025, which came to be rejected on 25.02.2026 in the proceedings in Civil Appeal No. 82 of 2014 Akhilesh Kumar and others vs. Harish Chandra Memorial and others by the Court of Addl. District Judge, Court No.3, Bijnor.
3. Questioning the said order, the present petition has been preferred.

Learned counsel for the petitioner has sought to argue that the order impugned cannot be sustained for the simple reason that there were justifiable grounds seeking recall of the order as on account of the death of one of the relatives the evidences could not be adduced, however, there were valid reasons in the application, thus the order dated 31.01.2024 ought to have been recalled.
5. I have heard the submissions so made across the Bar and perused the records carefully.
6. Apparently, in Civil Appeal no. 82 of 2014, an order closing the evidence came to be passed on 31.01.2024. Recall application came to be preferred, which has been rejected. The considerations, which weighed with the lower appellate court while rejecting the said application is that on 18.07.2018, opportunity was accorded to adduce evidence. As a matter of fact, various dates were fixed and several opportunities were accorded and on 02.08.2023, the opportunity to adduce evidence stood closed and on 29.06.2023, in the interest of the litigants on deposit of the cost of Rs.1000/- another opportunity was accorded. Thereafter on 09.10.2023, adjournment was accorded on payment of Rs.500/- and again on 25.10.2023, adjournment was accorded on deposit of Rs.700/- and on 10.11.2003, opportunity was accorded on the deposit of Rs.1000/- on 30.11.2023, and last opportunity was accorded on 15.12.2023 and then on 03.01.2024, on deposit of Rs.500/- again on 12.01.2024 on deposit of Rs.500/-, on 19.01.2024 again opportunity was accorded followed on 23.01.2024 and 31.01.2024.
7. Interestingly, in the entire petition, there is no recital that the date so mentioned in the order impugned and the opportunity so accorded is incorrect. The order impugned reads as under:-

Since dilatory tactics have been adopted at all levels and there is no dispute to the number of opportunities accorded to the petitioner, thus in the fitness of the matter, bearing in mind that it is not apparent that there has been miscarriage of justice, this Court does not find it appropriate to interfere at this stage.
9. Accordingly, the writ petition is dismissed.
