1. The present Regular First Appeal under Section 96 of the Code of
Civil Procedure, 1908 (hereinafter referred to as ‘CPC’) has been filed on
behalf of the Defendant/Appellant against the Judgment and Decree dated
30.11.2024, passed by the learned District Judge, New Delhi, whereby the
Suit of the Plaintiff/Respondent for Specific Performance and Permanent
Injunction was dismissed, but the Defendant/Appellant was directed to
refund a sum of Rs.17,00,000/- to the Plaintiff/Respondent, along with
pendente lite and future interest @ 8% per annum.
