The above appeal is preferred by the claimant against
the inadequate compensation awarded by the Additional
Motor Accidents Tribunal – II, Kasaragod vide order dated
12.05.2022 in O.P.(MV) No. 494 of 2018.
2. It is the case of the appellant that, while the
appellant was on the way from Chattanchal to
Parassinikkadavu in an autorickshaw bearing Registration No.
KL-14-L-1746 the autorickshaw was hit by a lorry bearing
Registration No. MH-09-CW-3177, driven by the 1 st respondent
in a rash and negligent manner. Due to the said accident, the
appellant sustained serious injuries and was taken to a
hospital at Kasaragod. Thereafter, he was taken to Father
Muller Hospital, Mangalore and was admitted there as an
inpatient. The 1st respondent is the driver, the 2nd respondent
is the registered owner and the 3rd respondent is the insurer.
The appellant claimed ₹30,00,000/- (Rupees thirty lakhs
only) towards compensation. However, the tribunal awarded
only ₹18,48,800/-. This is the reason why the appeal has been
preferred.
