    1. After arguing for a while, Mr. M.A. Bhat, learned counsel for the

    petitioner, when confronted with the maintainability of the instant petition,

    which according to the petitioner has been preferred under Section 528 Bhartiya

    Nagarik Suraksha Sanhita 2023 read with Section 561-A of Criminal Procedure

    Code (Jammu and Kashmir) and Article 227 of the Constitution of India,

    whereby the petitioner has sought quashment of order dated 05.12.2025 passed

    by the learned 3rd Additional Sessions Judge (Special Judge under Unlawful

    Activities Prevention Act), Jammu in the final report submitted by the Police in

    FIR No. 169/2010 of the Police Station, Gandhi Nagar, makes a categoric

    statement that the prayer of the petitioner, insofar as, the petitioner has filed the

    petition under Article 227 of the Constitution of India may be deleted and

    requests the Court that the instant petition be treated only under Section 528

    Bhartiya Nagarik Suraksha Sanhita 2023. Prayer allowed.
