1. Learned counsel for the petitioner, Mr. Ranjeev Dubey, submits that his
petition has been wrongly clubbed with the aforesaid matter. His statement
is taken on record.
2. Registry is directed to de-link this matter and list separately on 10.08.2026.
3. Meanwhile, interim direction, if any, shall continue.

1. The petitioner through the medium of this petition seeks transfer of divorce
petition filed by the respondent which is pending in the Court of Principal
District Judge, Kathua to the Family Court at Jammu.
2. It is contended that inter se parties multiple proceedings are underway. The
petitioner has also filed petition under the DV Act which is pending in the
Court of learned City Judge, Jammu besides this, she has also sought
damages from the respondent-husband for wilfully publishing/posting
defamatory, baseless, malicious content. The respondent herein who has

filed a petition separate divorce under Section 13 of the Hindu Marriage
Act, 1955 against petitioner herein has in terms of Trp (C) No. 04/2026
sought transfer of divorce petition from the learned Principal Judge, Family
Court, Jammu to the learned Principal District, Judge, Kathua and this
Court in terms of order dated 03.03.2026 has proceeded to stay the
proceedings in the divorce petition filed by the petitioner.
3. It is submitted that Section 21 A of the Hindu Marriage Act, 1955, on
which the respondent has relied in terms of order dated 03.03.2026, does
not apply to the case of the parties rather the parties are governed by
Section 21 of the Hindu Marriage Act, 1955 Act.
4. Issue notice to the respondent, returnable within two weeks, subject to
taking of requisite steps for service within one week.
5. Dasti service is also permitted.
6. List on 21.08.2026.
7. Meanwhile, subject to objections from the other side and till next date of
hearing before the Bench, proceedings before the Court of learned Principal
District Judge Kathua in divorce petition namely “Dr. Amit Vikram Raina
vs. Dr. Sonam Billawaria” shall remain stayed.
