3. All these bail applications relate to similar offences by
persons connected with Sanjivani Credit Co-operative Society Ltd,
hence they are being decided by a common order.
4. The petitioners are facing prosecution in several FIRs lodged
by different investors who had deposited their money with
Sanjivani Credit Co-operative Society Ltd. The allegation in all the
FIRs is that the respective complainants invested certain amounts
with the said credit co-operative society, and upon the maturity of
their deposits, the society failed to repay the matured amounts. It
is alleged that, by dishonestly withholding the maturity amount
and failing to honour its commitments, the petitioners connected
with the society cheated the investors, thereby attracting the
offence of cheating.
5. Heard learned counsel for the petitioners as well as learned
Public Prosecutor and perused the material available on record.

6. Learned counsel for the petitioners submits that the
petitioners have falsely been implicated in the present cases. They
further submit that the petitioners were initially arrested in
connection with FIR No. 32/2019 registered by the SOG, Jaipur,
wherein the Hon’ble Supreme Court, vide order dated 17.12.2024,
enlarged the petitioner Devi Singh. Learned counsel for the
petitioners further submits that a co-ordinate Bench of this Court
vide order dated 30.01.2026 in S.B. Cr. Misc. Bail Appl. No.
15138/2025 titled as Shaitan Singh Vs. State of Rajasthan had
already granted the benefit of bail to accused-petitioner Shaitan
Singh by way of a detailed order.
Learned counsel for the petitioners further submits that the
allegations in the present cases arise out of transactions
pertaining to the Sanjivani Credit Co-operative Society Ltd. and in
majority of them, FIR has been filed under Sections 406 and 420
IPC, wherein the maximum punishment that may be imposed
upon the petitioner(s) would be seven years, provided the
sentences are directed to run concurrently. He further contends
that the petitioners have already remained in judicial custody as

Which reflects that in most of the cases, petitioners are
behind the bars for more than four to six years.
Learned counsel further submits that in several other cases
involving identical allegations of offence arising out of the same
transactions, the Coordinate Benches of this Court have already
enlarged the present petitioners on bail vide orders dated
04.05.2026, 05.05.2026, 15.05.2026, 26.05.2026 and
30.06.2026.
Learned counsel argued that charge-sheet has been filed.
The trial is likely to take considerable time to conclude and,
therefore, the continued incarceration of the petitioners would
amount to an unreasonable deprivation of right to a speedy trial.
It is thus contended that no useful purpose would be served by
keeping the petitioners in further judicial custody, and the
petitioners deserve to be enlarged on bail.
7. Learned Public Prosecutor has vehemently opposed the bail
application by contending that petitioners are habitual offenders
and there are criminal antecedents against them as against Devi

Singh there are twenty one cases and against Shaitan Singh there
are twenty cases. Hence, petitioners are not entitled for the bail.
8. On consideration of the rival submissions, material available
on record and in light of the maximum punishment prescribed
therefor, and the prolonged incarceration undergone by the
petitioners, coupled with the fact that the Hon’ble Supreme Court,
vide order dated 17.12.2024, has already enlarged the petitioner-
Devi Singh on bail in FIR No. 32/2019 registered by the SOG,
Jaipur, and that Coordinate Benches of the Principal Seat at
Jodhpur as well as this Court have thereafter granted bail to both
the petitioners in other cases arising out of similar allegations.
Hence, in view of the institutional coherence and there being no
distinguishing feature warranting a departure, this Court is of the
considered opinion that the petitioners have made out a fit case
for grant of bail. Accordingly, without expressing any opinion on
the merits or demerits of the case, I am inclined to extend the
benefit of bail to the petitioners.
9. Consequently, the bail applications under Section 483
B.N.S.S. are allowed and it is directed that the petitioners Shaitan
Singh S/o Uttam Singh and Devi Singh S/o Shri Keshar
Singh, be released on bail provided each of them furnishes a
personal bond in the sum of Rs.50,000/- with two sureties in the
sum of Rs.25,000/- each to the satisfaction of the learned trial
court with the stipulation that they shall appear before that Court
on all subsequent dates of hearing till conclusion of the trial.
