    The instant complaint is filed by complainant against
    accused under Section 200 of Cr.P.C for the offence
    punishable under Section 138 of N.I.Act and punish the
    accused in accordance with law and direct the accused to
    pay the cheque amount alongwith fine amount to the
    complainant in the interest of justice and equity.

    2. The brief facts of the case of the complainant is that:

    It is submitted that, the complainant and accused are
    known to each other since 2020. The accused being the
    owner of property situated at 2nd Floor, 1st House, 9th Cross,
    Mehboob Garden, Kogilu Layout, Yelahanka,
    Bengaluru-64. The complainant was interested to occupy
    the said premises on lease basis and in that regard the
    Judgment 3 C.C.No.8732/2025

    lease agreement was entered between complainant and
    accused on 14.09.2020 and as per lease agreement, the
    complainant had paid the lease amount of Rs.3,00,000/-
    to the accused through cheque bearing No.131075 dated
    14.09.2020. Thereafter, the complainant requested the
    accused to handover the possession of said premises, but
    the accused has not handed over the same. The
    complainant came to know that the said premises was
    occupied by some other tenant, accordingly the
    complainant had demanded the accused for return of his
    lease amount, at that time the accused had sought time for
    repayment of the said amount and agreed to pay
    Rs.6,000/- every month to the complainant as damages
    until to repayment of the said amount.
