1. The present Regular First Appeal under Section 96 read with Order
XLI of the Code of Civil Procedure, 1908 (hereinafter referred to as
„CPC’), has been filed on behalf of the Appellant/Defendant, against the
Judgment and decree dated 31.01.2024, of the learned Additional District
Judge,whereby the Suit of the Plaintiff/Respondent was decreed for mesne
profits at Rs.80/- per sq. ft. in respect of the Suit Property from 01.04.2010
till 29.04.2022, along with simple interest at 9% per annum on the due
amount, from 01.04.2010 till 29.04.2022, and costs.
