    1. This Criminal Appeal, under Section 374 (2) of the Code of Criminal Procedure, 1973 (for brevity ‘Cr.P.C.’), has been filed by convicts Mahanth and Ram Chandra, against the judgment and order dated 22.10.1982, passed by Sri Jagdish Prasad, the then VI Additional Sessions Judge, Deoria, in Sessions Trial No. 242 of 1979, arising out of Case Crime No. 172 of 1976, Police Station Kasia, District Deoria.

By the impugned judgment and order both the appellants, to wit, Mahanth and Ram Chandra, were convicted under Section 365/34 of Indian Penal Code,1860, (for brevity ‘IPC’) and instead of sentencing them to undergo imprisonment, they were given benefit of Section 4 of Probation of Offenders Act, 1958, and were directed to be released upon furnishing a personal bond of Rs.5000/- each and two sureties of the like amount, on probation for two years, upon keeping good conduct and maintaining peace.
