[1] These matters are taken up on mentioning due to urgency
involved in the matters in Supplementary-2.
[2] Heard Mr. N. Ibotombi, learned senior counsel assisted by Ms. Y.
Jinita, learned counsel for the petitioner.
[3] The petitioner, who is a Joint Director of Handlooms & Textiles, is
aggrieved by the order dated 06-07-2026 issued by the Joint Secretary (DP),
Government of Manipur wherein respondent No. 3, Mr. Moirangthem Kapajit
Singh, MCS, has been posted as Joint Secretary (Home) & Staff Officer to
Chief Secretary & i/c Director (Handlooms & Textiles). It is submitted that
the petitioner is presently holding the substantive post of Joint Director
(Handlooms & Textiles) & also i/c Director (Handlooms & Textiles) vide order
dated 04-03-2025. The petitioner is aggrieved by the portion of the order
dated 06-07-2026 wherein respondent No. 3 has been given assignment of
i/c Director (Handlooms & Textiles). Mr. N. Ibotombi, learned senior counsel

for the petitioner, draws the attention of this Court to the Recruitment Rules
of 2022 of the post of Director (Handlooms & Textiles) wherein Column No.
10, it states that by promotion failing which by deputation and Column No.
11, it states that for promotion — 5 (five) years regular service as Joint
Director (Handlooms & Textiles) and for deputation — Officer holding
analogous post or next lower post with 10 (ten) years regular service in the
grade; possessing Degree/Diploma in Handlooms, Textiles Technology. It is
submitted that respondent No. 3 does not serve in the analogous post and
he is an MCS officer without any training in Handlooms & Textiles and he is
not eligible for making i/c Director of Handlooms & Textiles. Mr. N. Ibotombi,
learned senior counsel for the petitioner, also submits that i/c Director
(Handlooms & Textiles) has to be considered from the feeder cadre, i.e. from
Joint Director (Handlooms & Textiles) and in any case, the conferring of i/c
Director (Handlooms & Textiles) to respondent No. 3 is against the
Recruitment Rules of 2022.
[4] Issue notice. [5] Mr. Niranjan Sanasam, learned Government Advocate, accepts
notice on behalf of respondent Nos. 1 & 2 and the petitioner is directed to
take steps to respondent No. 3 by speed post within one week and file an
affidavit of proof of service.
[6] Learned Government Advocate prays for three weeks’ time for
filing counter affidavit.
[7] This Court has considered the material on record. As per the
Recruitment Rules, of 2022, the appointment to the post of Director
(Handlooms & Textiles) is by promotion from the cadre of Joint Director

(Handlooms & Textiles), failing which, by deputation from the officer having
analogous post with 10 (ten) years regular service. Admittedly, respondent
No. 3 is not holding analogous post. In the circumstances, the portion of the
impugned order dated 06-07-2026 conferring i/c Director (Handlooms &
Textiles) to respondent No. 3 is kept under suspension till the next date.
[8] List these cases before the roster Bench on 10-08-2026.
[9] Furnish a copy of this order to the learned counsel appearing for
the parties in the course of the day by Whatsapp or any other available
modes.
