    1. This is a bail application U/S.483 of BNSS

    by the petitioner for grant of bail in connection with

    SPONSORED

    Badagada PS Case No.556 of 2025 corresponding to TR

    Case No.588 of 2025 pending in the file of learned

    Special Judge(POCSO)-cum-Addl. Sessions Judge,

    Bhubaneswar, for being charge sheeted for commission

    of offences punishable U/Ss.363/354-A/506/34 of IPC

    read with Sec. 8, 12 & 17 of POCSO Act along with co-

    accused persons.

    2. The allegation as emerges against the

    petitioner is that on 14.07.2023 at 6PM while the victim

    was present near her tuition, the present petitioner

    along with other accused persons asked her to sit in

    their car, but the victim refused and thereafter, they

    forcibly took her to Puri bypass road and forced her to

    consume alcohol and the victim when become

    unconscious, the petitioner raped her and took her

    obscene photos and videos. The accused persons had

    also threatened the victim to get her photograph and

    video viral in social media. On the aforesaid allegation,

    the FIR was lodged against the petitioner and others for

    commission of offence punishable U/Ss.

    363/376(1)/323/506 of IPC read with Sec. 4 of the

    POCSO Act, resulting in commencement of

    investigation, in the course of which the statement of

    the victim was recorded by the IO as well as by the

    learned Magistrate. On conclusion of investigation, the

    petitioner was charge sheeted for commission of

    offences punishable U/Ss. 363/354-A/506/34 of IPC

    read with Sec. 8 & 12 of POCSO Act and co-accused

    persons were charge sheeted U/Ss. 363/506/34 of IPC

    read with Sec. 17 of POCSO Act. Finding prima facie

    materials, the petitioner was taken into custody and

    when his bail was turned down by the learned Special

    Court, POCSO, Bhubaneswar, he is before this Court.

    The petitioner had earlier approached this Court in

    BLAPL No. 11482 of 2025 which was in fact rejected by

    this Court on 2nd February, 2026. This is how the

    petitioner is before this Court in the present bail

    application.
