    Constitution seeks further investigation on FIR No.

    233 of 2007, so that the charge could be altered from

    one under Section 302 IPC to Section 304 IPC.

    Reason: first information report was not only investigated

    but, on submission of police report, a trial was held

    which resulted in conviction of the accused under

    High Court and, thereafter, a special leave petition

    preferred before this Court was dismissed.

    4. In such circumstances, this petition is

    completely misconceived, and is, accordingly,

    dismissed.

    5. Pending applications, if any, shall stand

    disposed of.
