UPON hearing the counsel the Court made the following
O R D E R
1. Heard Mr. Sudhir Naagar, learned counsel for the
petitioner and Dr. Vijendra Singh, learned standing
counsel for the State.
2. The petitioner calls in question the correctness of
the order dated 01.04.2026 in Criminal Misc. Bail
Application No. 22826 of 2025 passed by the High Court
of Judicature at Allahabad. By the said order, the
petitioner has been denied the benefit of bail in
connection with Case Crime/FIR No. 676 of 2023
registered with Dadri Police Station, District Gautam
Budh Nagar, Uttar Pradesh, for the offences punishable
under Sections 325, 326, 307, 34, 120B and 506 of the
IPC.
3. Learned counsel for the petitioner drawing
attention to the facts and circumstances of the case
and deposition of PW-1 (injured/complainant) and
contends that the petitioner has a good prima facie
case at the trial. Learned counsel for the petitioner
submits that the petitioner had already undergone about
two and a half year in custody.
4. Learned counsel for the State, however, vehemently
defends the impugned order.
5. Having considered the overall facts and
SLP (Crl.) No(s). 11737/2026 2 of 3
circumstances of the case, we are inclined to enlarge
the petitioner on bail pending trial.
6. Accordingly, we direct that the petitioner shall be
enlarged on bail subject to the satisfaction of the
Trial Court in connection with the aforesaid FIR for
the offences mentioned hereinabove.
7. The Special Leave Petition is disposed of in the
above terms.
8. Pending application(s), if any, shall also stand
disposed of.
