    The original plaintiff by name Venkata Reddy S. R.,

    has maintained the present suit for the relief of

    SPONSORED

    declaration to declare that the plaintiff is the absolute

    owner of the Suit Schedule Property and consequentially

    to grant the relief of permanent injunction directing the

    Defendant not to interfere with his peaceful possession

    and enjoyment of the Suit Schedule Property and further

    to order for grant of mandatory injunction directing the

    Defendant to demolish any structure that he might have

    put on the Suit Schedule Property along with costs.

    2. The facts in brief of the plaintiff’s case is that the

    original plaintiff claims to be the absolute owner and in

    possession of the Suit Schedule Property. The plaintiff

    also contended that the plaintiff had purchased 1 acre 20

    guntas of land in Sy.No.84/2 of Byrasandra Village,

    Jayanagar East, Bengaluru from the children of one D. N.

    Krishna Murthy under a deed of sale dated 05.11.1961

    and out of said land 26 guntas was acquired by the

    Bengaluru Development Authority and remaining two

    guntas of kharab land was given to the temple and vendor

    of the plaintiff has also received the compensation in

    respect of said BDA acquired land of 26 guntas.
