This case is registered against the accused for the
offence punishable U/s 138 of Negotiable Instruments
Act.

2. Factual matrix of the complainant’s case is as
under:
It is stated that the accused has entered into rental
agreement with the complainant vide rental agreement
dated 05.03.2021, wherein the accused has agreed to let
out the premises for rent. Under the rent agreement the
complainant had paid refundable security deposit amount
of Rs.5,00,000/- by way of cash. But the accused has failed
to handover the possession of the premises for the
reason that some small repair works were pending and
after completion of the work, he agreed to deliver the
possession.
