offence punishable U/s 138 of Negotiable Instruments
Act.

2. Factual matrix of the complainant’s case is as
under:
It is stated that the complainant’s husband i.e.
deceased Mr.Anand and sister of accused by name
Smt.Shwetha.S Bhat, shared a good relationship and they
were reliable friends. Out of the acquaintance with the
sister of the accused, the complainant’s husband met with
accused. The accused expressed his willingness and
intend to commence a new business and sought financial
assistance from the complainant’s husband. Accordingly,
the husband of the complainant has paid Rs.20,00,000/-
by way of cash by pledging gold owned by complainant
and her husband, as requested by the accused and the
accused has agreed to return it within 3 years.
