JUDGMENT
Anil K. Narendran, J.
The petitioners, who are applicants 1, 4, 5, 6, 9, 10, 11
and 12 in O.A.No.1212 of 2024 on the file of the Kerala
Administrative Tribunal, Thiruvananthapuram, have filed this
original petition, invoking the supervisory jurisdiction of this
Court under Article 227 of the Constitution of India, seeking an
order to set aside Ext.P1 order dated 18.06.2025 of the Tribunal
in that original application, which was one filed by them, along
with respondents 14 to 18 herein, invoking the provisions under
Section 19 of the Administrative Tribunals Act, 1985, seeking an
order to set aside the rejection of their candidature to the post
of Dairy Farm Instructor in Kerala Dairy Development
Department, based on Annexures A15 to A26(a) profiles; an
order directing respondents 1 and 2, i.e., the Kerala Public
Service Commission and its Secretary, to include them in
Annexure A14 short list and also in the ranked list for Dairy Farm
Instructor in Kerala Dairy Development Department; a
declaration that the applicants are fully qualified, as on
31.01.2023, for submitting application to the post of Dairy Farm
Instructor in Kerala Dairy Development Department, as notified

in Annexure A1 notification dated 31.12.2022 (category
No.691/2022); an order directing the 1st respondent Public
Service Commission to include the applicants in Annexure A65
ranked list for appointment to the post of Dairy Farm Instructor
in Kerala Dairy Development Department, which was brought
into force with effect from 05.12.2024; and an order directing
the 1st respondent Public Service Commission to issue advice to
the applicants in accordance with their rank in Annexure A65
ranked list. The relief sought for in O.A.No.1212 of 2024 in
respect of Annexure A65 ranked list were sought by way of an
amendment, since the said ranked list was published by the
Public Service Commission during the pendency of that original
application.
2. Before the Tribunal, respondents 1 and 2 filed Ext.P6
reply statement on 23.10.2024, opposing the reliefs sought in
O.A.No.1212 of 2024. Certain candidates, who are included in
Annexure A65 ranked list, got themselves impleaded as
additional respondents 3 to 12. They filed Ext.P7 reply statement
dated 02.03.2025 in O.A.No.1212 of 2024, opposing the reliefs
sought for, producing therewith Annexures R3(a) to R3(h)
documents. The said reply statement was followed by Ext.P8

reply statement dated 27.02.2025 filed by the additional 13th
respondent.
3. After considering the pleadings and materials on
record, the Tribunal, by Ext.P1 order dated 18.06.2025,
dismissed O.A.No.1212 of 2024, for the reasons stated therein.
Paragraphs 8 to 12 of Ext.P1 order read thus;
“8. The applicants have produced various documents to
show that they were qualified as on the last date fixed for
receipt of applications, viz., 01.02.2023. But the
documents they produced, in order to establish the same
are provisional certificates, which only say that the
applicants passed all the professional examinations and
successfully completed the course work in January, 2023.
At the same time, Annexures A51 to 62(a) would show
that the date of Result Notification is 02.02.2023.
9. Though the additional 13th respondent filed a reply
statement stating that the provisional certificates would
show that the applicants procured their qualification in
January 2023 itself, nothing is stated regarding the date
on which the Result Notification was published. But at the
same time, it is stated that the date shown as
‘02.02.2023’ in Annexures A51 to A62(a) is only the time
period taken for internal processing of results and does
not indicate the date of procurement of qualification. That
would show that the results were published only on
02.02.2023. Annexures A51 to A62(a)-Transcript of
Record of Work, issued by the Director, do not show that

2026:KER:40693the results of the examinations were published on or
before 01.02.2023. At the same time those documents
would show that the date of result notification is
02.02.2023.
10. Moreover, there is no explanation for the applicants to
the averments in the reply statement of additional
respondents 3 to 12 that the viva-voce examination was
conducted for the applicants only on 28.01.2023 and the
results were published on 02.02.2023. Apart from all
these, Annexure R3(f) is the notification issued by the
Director, KVASU, which shows that the result was
published only on 02.02.2023.
11. All these materials would indicate that the applicants
were qualified only on 02.02.2023. The materials
produced by the applicants do not indicate that the result
was published on 01.02.2023. It is settled law that
whenever a qualification like Degree or Diploma or the like
are prescribed as the qualification for a post, the results
of the examination in that course ought to have been
published as on the last date fixed for receipt of
application. As held by the Apex Court in the judgment in
Charles K. Scaria v. Dr. C. Mathew [(1980) 2 SCC
752] a candidate can be said to have acquired a Degree
only when the results are officially made known. He
should have not only completed the course before the last
date fixed for receipt of application; but the results of the
examination should also have been published before that
date. In the present case it is seen that the results of the
applicants were published only on 02.02.2023, after the
last date fixed for application was over. Therefore, the

2026:KER:40693action of the PSC in rejecting their applications cannot be
said to be illegal.
12. The original application fails and it is dismissed
accordingly.”
4. Challenging Ext.P1 order dated 18.06.2025 of the
Tribunal in O.A.No.1212 of 2024, the petitioners-applicants are
before this Court in this original petition.
5. On 09.10.2025, when this original petition came up
for admission, this Court passed an interim order to the effect
that any appointment made to the post of Dairy Farm Instructor
in the Kerala Dairy Development Department, from Annexure
A65 ranked list, will be subject to the outcome of this original
petition.
6. Heard arguments of the learned counsel for the
petitioners-applicants, the learned Standing Counsel for Kerala
Public Service Commission for respondents 1 and 2 and also the
learned counsel for respondents 3 to 5, 10 and 11.
7. The learned counsel for the petitioners-applicants
would contend that Ext.P1 order dated 18.06.2025 of the
Tribunal in O.A.No.1212 of 2024 is one passed without adverting
to the legal and factual contentions raised by the applicants. The
reasoning of the Tribunal in Ext.P1 order is perverse and patently

illegal, which warrants interference in this original petition.
Placing reliance on Annexures A39 to Annexure A50(a)
certificates issued to the applicants by the Director of Academics
and Research, Kerala Veterinary and Animal Sciences University,
the learned counsel for the petitioners would contend that as on
the last date prescribed in Annexure A1 notification, i.e.,
01.02.2023, the applicants possessed the required qualification,
since it is stated in the said certificates that they were qualified
to receive the Degree of B.Tech (Dairy Technology) on
28.01.2023, with an overall grade point average stated therein.
8. In support of the aforesaid contention, the learned
counsel for the petitioners-applicants would point out the stand
taken by the additional 13th respondent Kerala Veterinary and
Animal Sciences University in paragraphs 4 and 5 of Ext.P8 reply
statement dated 27.02.2025 filed in O.A.No.1212 of 2024, which
reads thus;
“4. It is submitted that the applicants completed their
course B.Tech (Dairy Technology) from September 2018
to January 2023 and procured a provisional degree
certificate on the dates as seen in Annexures A27 to A38
(a). The provisional certificate affirms that the petitioners
have procured their qualification as early as January 2023.
5. In fact, the date shown as 02.02.2023 in Annexures

2026:KER:40693A51 to Annexure A62(a) under ‘Result Notification no. and
date’ is only the time period taken for internal processing
of results and does not indicate the date of procurement
of qualification. The same Annexures A51 to 62(a) would
show that Month and year of completion of the
programme is ‘January 2023’.
The learned counsel for the petitioners would also place reliance
on Ext.P9 judgment of a Division Bench of the Madras High Court
in K. Pandiyan v. The Director of Elementary Education,
Chennai and others [2022 SCC OnLine Mad 4371].
9. On the other hand, the learned Standing Counsel for
the Kerala Public Service Commission would place reliance on
the result notification number and date mentioned in Annexures
A51 to A62(a) transcript of the record of work issued to the
applicants by the Director of Academics and Research, Kerala
Veterinary and Animal Sciences University dated 25.03.2023,
wherein it is stated that the result was published on 02.02.2023,
vide notification No.KVASU/DAR/ACAD/E2/30983/2019. The
learned Standing Counsel has also placed reliance on Condition
No.17 of the General Conditions in Part II, which forms part of
Annexure A1 notification dated 31.12.2022, inviting applications
for the post of Dairy Farm Instructor in the Kerala Dairy
Development Department (Category No.691/2022). The learned

Standing Counsel has also pointed out the stand taken by the
Public Service Commission in Ext.P6 reply statement filed on
23.10.2024 in O.A.No.1212 of 2024, on behalf of respondents 1
and 2.
10. The issue that requires consideration in this original
petition is as to whether any interference is warranted on Ext.P1
order dated 18.06.2025 of the Tribunal in O.A.No.1212 of 2024,
in exercise of the supervisory jurisdiction of this Court under
Article 227 of the Constitution of India.
11. Article 227 of the Constitution of India deals with
power of superintendence over all courts by the High Court.
Under clause (1) of Article 227 of the Constitution, every High
Court shall have superintendence over all courts and tribunals
throughout the territories in relation to which it exercises
jurisdiction.
12. In Shalini Shyam Shetty v. Rajendra Shankar
Patil [(2010) 8 SCC 329] the Apex Court, while analysing the
scope and ambit of the power of superintendence under Article
227 of the Constitution, held that the object of superintendence,
both administrative and judicial, is to maintain efficiency, smooth
and orderly functioning of the entire machinery of justice in such

a way as it does not bring it into any disrepute. The power of
interference under Article 227 is to be kept to the minimum to
ensure that the wheel of justice does not come to a halt and the
fountain of justice remains pure and unpolluted in order to
maintain public confidence in the functioning of the tribunals and
courts subordinate to the High Court.
13. In Jai Singh v. Municipal Corporation of Delhi
[(2010) 9 SCC 385], while considering the nature and scope
of the powers under Article 227 of the Constitution of India, the
Apex Court held that, undoubtedly the High Court, under Article
227 of the Constitution, has the jurisdiction to ensure that all
subordinate courts, as well as statutory or quasi-judicial
tribunals exercise the powers vested in them, within the bounds
of their authority. The High Court has the power and the
jurisdiction to ensure that they act in accordance with the well
established principles of law. The exercise of jurisdiction must be
within the well recognised constraints. It cannot be exercised
like a ‘bull in a china shop’, to correct all errors of the judgment
of a court or tribunal, acting within the limits of its jurisdiction.
This correctional jurisdiction can be exercised in cases where
orders have been passed in grave dereliction of duty or in

flagrant abuse of fundamental principles of law or justice.
14. In K.V.S. Ram v. Bangalore Metropolitan
Transport Corporation [(2015) 12 SCC 39] the Apex Court
held that, in exercise of the power of superintendence under
Article 227 of the Constitution of India, the High Court can
interfere with the order of the court or tribunal only when there
has been a patent perversity in the orders of the tribunal and
courts subordinate to it or where there has been gross and
manifest failure of justice or the basic principles of natural justice
have been flouted.
15. In Sobhana Nair K.N. v. Shaji S.G. Nair [2016 (1)
KHC 1] a Division Bench of this Court held that, the law is well
settled by a catena of decisions of the Apex Court that in
proceedings under Article 227 of the Constitution of India, this
Court cannot sit in appeal over the findings recorded by the
lower court or tribunal and the jurisdiction of this Court is only
supervisory in nature and not that of an appellate court.
Therefore, no interference under Article 227 of the Constitution
is called for, unless this Court finds that the lower court or
tribunal has committed manifest error, or the reasoning is
palpably perverse or patently unreasonable, or the decision of

the lower court or tribunal is in direct conflict with settled
principles of law.
16. In view of the law laid down in the decisions referred
to supra, the High Court in exercise of its supervisory jurisdiction
under Article 227 of the Constitution of India cannot sit in appeal
over the findings recorded by the Administrative Tribunal. The
supervisory jurisdiction cannot be exercised to correct all errors
in the order of the Administrative Tribunal, acting within the
limits of its jurisdiction. The correctional jurisdiction under Article
227 can be exercised only in a case where the order of the
Administrative Tribunal has been passed in grave dereliction of
duty or in flagrant abuse of fundamental principles of law or
justice. Therefore, no interference under Article 227 is called for,
unless the High Court finds that the Administrative Tribunal has
committed a manifest error, or the reasoning is palpably
perverse or patently unreasonable, or the decision of the
Tribunal is in direct conflict with settled principles of law or where
there has been gross and manifest failure of justice or the basic
principles of natural justice have been flouted.
17. The issue raised in this original petition centres
around Annexure A1 notification dated 31.12.2022 issued by the
O.P.(KAT)NO.353 OF 2025

Kerala Public Service Commission inviting online applications
from qualified candidates for appointment to the post of Dairy
Farm Instructor in Kerala Dairy Development Department
(Category No.691/2022). The last date for submission of online
application in Annexure A1 notification was 01.02.2023. The
qualification prescribed in Annexure A1 notification reads thus;
“Qualifications: Graduation with either Mathematics or
Biology as one of the optional subjects for the Pre-Degree
course
Note:1. Training:- Every candidate selected for
appointment as Dairy Farm Instructor shall undergo eight
months training before they are appointed regularly. The
training shall be imparted by the Dairy Development
Department. They shall be paid the minimum of the basic
pay of Dairy Farm Instructor per mensum as consolidated
allowance during the period of training. The period of
training shall not be counted for probation and increment.
2. Rule l0 a (ii) of part II of KS&SSR is applicable.
3. In addition to the qualifications prescribed in the
notification, the qualifications recognized by executive
orders, or standing orders of Government as equivalent to
a qualification specified for a post, in the Special Rules and
such of those qualifications which pre-suppose the
acquisition of the lower qualification prescribed for the
post, shall also be sufficient for the post. The copy of the
Government orders declaring equivalent/higher
qualifications shall be produced as and when required by

Probation: Every person appointed to the post shall from
the date on which he/she joins duty be on probation for a
total period of two years on duty within a continuous
period of three years.”
18. In view of Clause 9 of Annexure A1 notification, which
deals with last date for receipt of applications, online applications
can be submitted till 01.02.2023 (Wednesday) up to 12
midnight. In Annexure A1 notification, after Clause 11, it is
stated that for details including photo, ID card, etc. the
candidates have to refer the general conditions given in Part II
of the Gazette Notification.
19. Pursuant to Annexure A1 notification, the applicants
submitted online applications, and they were issued with
Annexures A2 to A13(a) admission tickets (provisional) by the
Public Service Commission for the objective type (OMR
valuation) test, which was held on 16.12.2023. After the conduct
of OMR test, Annexure A14 short list containing the register
number of candidates, who were found provisionally eligible to
be called for interview, subject to verification of original
documents, for appointment to the post of Dairy Farm Instructor
in the Kerala Dairy Development Department was published on

09.07.2024. In the process of document verification, the
applications made by the petitioners-applicants were rejected,
as evidenced by Annexures A15 to A26(a), on the ground that
they do not possess the required qualification as on the last date
for submission of applications prescribed in Annexure A1
notification.
20. The documents marked as Annexures A27 to A38(a)
are provisional certificates dated 14.02.2023 and 22.02.2023
issued by the additional 13th respondent Kerala Veterinary and
Animal Sciences University, wherein it is certified that the
applicants have passed all the professional examinations of
B.Tech (Dairy Technology) programme and has successfully
completed the course work in January 2023. In Annexures A39
to A50(a) certificates dated 25.05.2024 and 28.02.2024, it is
certified that the applicants were students of the College of Dairy
Science and Technology, Thiruvananthapuram, a constituent
college of the Kerala Veterinary and Animal Sciences University,
during the period from September, 2018 to January, 2023, who
are qualified to receive the degree of B. Tech. (Dairy Technology)
on 28.01.2023 with an overall grade point average, as stated
therein.

21. Condition No.17 of the General Conditions in Part II,
which forms part of Annexure A1 notification dated 31.12.2022,
inviting applications for the post of Dairy Farm Instructor in the
Kerala Dairy Development Department (Category No.691/
2022), reads thus;
“17. Qualifications prescribed, including experience, for a
post shall be one acquired by the candidate on or before
the last date fixed for receipt of applications for that
particular post. The date for determining whether a
candidate does possess a particular qualification including
experience shall be the last date fixed for receipt of
application. Candidates possessing qualifications
equivalent to those prescribed for a post shall produce, in
addition to the documents referred to in Para 13(b),
sufficient proof obtained from a University or any other
competent authority to the effect that the qualifications
possessed by him/her are recognised as equivalent to
those prescribed for the post. The application of those who
failed to produce the proof regarding the equivalency of
the qualification possessed by them with that prescribed
in the notification, as and when required by the
Commission, will be rejected. In the case of the
examination conducted by the University or any other
competent authority, the candidates will be deemed to
have passed the examination only with effect from the
date of official publication of the results of the
examination by the University or the concerned authority.
Note:- The prescribed educational qualifications claimed

to produce a certificate showing the date of publication of
result of that qualification from the University/Board
concerned, as and when required by the Commission.”

22. In view of Condition No.17 of the General Conditions
in Part II, which forms part of Annexure A1 notification dated
31.12.2022, the qualifications prescribed, including experience,
for a post shall be one acquired by the candidate on or before
the last date fixed for receipt of applications for that particular
post. The date for determining whether a candidate does possess
a particular qualification including experience shall be the last
date fixed for receipt of application. In the case of the
examination conducted by the University or any other competent
authority, the candidates will be deemed to have passed the
examination only with effect from the date of official publication
of the results of the examination by the University or the
concerned authority. As per the Note to Condition No.17, if the

fact regarding the acquirement of the prescribed educational
qualification by a candidate on or before the last date for
submission of application of a post is not clear from the
certificate or mark lists concerned, he/she has to produce a
certificate showing the date of publication of result of that
qualification from the University/Board concerned, as and when
required by the Commission.
23. The document marked as Annexure A65 is the ranked
list published by the Public Service Commission for the post of
Dairy Farm Instructor in the Kerala Dairy Development
Department, which was brought into force with effect from
05.12.2024, in which the name of the applicants finds no place.
Relying on the materials placed on record in the original
application, the contention of the petitioners-applicants is that
they acquired the prescribed educational qualification in
Annexure A1 notification as on 28.01.2023 and as such, the
action of respondents 1 and 2 in rejecting their candidature on
the ground that they are not having the prescribed educational
qualification as on the last date of submission of application in
Annexure A1 notification, i.e., 01.02.2023, is per se arbitrary
and illegal.

24. As already noticed hereinbefore, in Annexures A51 to
A62(a) transcript of the record of works in B.Tech. (Dairy
Technology) programme issued to the applicants, the month and
year of completion of programme is stated as January 2023.
However, the result notification number and date mentioned in
the said documents are KVASU/DAR/ACAD/E2/30983/2019 and
02.02.2023 respectively. Therefore, in view of Condition No.17
of the General Conditions in Part II, which forms part of
Annexure A1 notification dated 30.12.2022, the petitioners-
applicants do not possess the prescribed qualification for
appointment as Dairy Farm Instructor in the Kerala Dairy
Development Corporation, on or before the last date prescribed
in that notification for the receipt of applications, i.e.,
01.02.2023.
25. When the fact regarding the acquirement of the
prescribed educational qualification by the applicants on or
before the last date for submission of applications pursuant to
Annexure A1 notification is clear from Annexures A51 to A62(a)
transcript of the record of work in B.Tech. (Dairy Technology)
programme issued by the Director of Academics and Research,
Kerala Veterinary and Animal Sciences University, no reliance

can be placed on Annexures A27 to A38(a) provisional
certificates issued by the additional 13th respondent Kerala
Veterinary and Animal Sciences University, wherein it is certified
that the applicants have passed all the professional
examinations of B.Tech. (Dairy Technology) programme and
have successfully completed the course work in January 2023;
or Annexures A39 to A50(a) certificates, wherein it is certified
that the applicants are qualified to receive the degree of B.Tech
(Dairy Technology) on 28.01.2023. The provisions contained in
the Note to Condition No.17 of the General Conditions in Part II,
which form part of Annexure A1 notification, which provide for
production of a certificate showing the date of publication of the
result of the qualification acquired from the University/Board
concerned, as and when required by the Commission, is
applicable only in a case in which the fact regarding the
acquirement of the prescribed educational qualification by a
candidate on or before the last date for submission of application
of a post is not clear from the certificate or mark list concerned.
In the instant case, the said fact is evident from Annexures A51
to A62(a) transcript of the record of work issued to the
applicants by the Director of Academics and Research, Kerala

Veterinary and Animal Sciences University, wherein it is stated
that the result was published on 02.02.2023, vide notification
No.KVASU/DAR/ACAD/E2/30983/2019.
26. Placing reliance on Ext.P9 decision of a Division Bench
of the Madras High Court in K. Pandiyan [2022 SCC OnLine
Mad 4371], the learned counsel for the petitioners-applicants
would contend that, once the results are declared, the date of
obtaining the qualification would be the last date of writing the
examination.
27. We do not find any force in the argument advanced
by the learned counsel for the petitioners-applicants, placing
reliance on the decision of the Madras High Court in K. Pandiyan
[2022 SCC OnLine Mad 4371], in which the Division Bench
was considering the claim of the appellant for inclusion of his
name in the panel for promotion as B.T. Assistant (Science). As
already noticed hereinbefore, in view of Condition No.17 of the
General Conditions in Part II, which forms part of Annexure A1
notification dated 31.12.2022 issued by the Kerala Public Service
Commission, a candidate has to acquire the prescribed
qualification on or before the last date fixed for receipt of
applications for that particular post. As per the Note to Condition

No.17, the prescribed educational qualifications claimed by the
candidates shall be deemed to be acquired by them only on the
date on which the final result of the course has been declared by
the University/Board concerned.
28. We do not find any force in the arguments advanced
by the learned counsel for the petitioners-applicants, placing
reliance on the decision of the Apex Court in Chancellor v. Dr.
Bijayananda Kar [(1994) 1 SCC 169] that the Court should
not ordinarily interfere with the decisions of the academic bodies
and the concerned selection committees, which invariably
consists of experts on the subjects relevant to the selection.
29. In Dr. Bijayananda Kar [(1994) 1 SCC 169] the
Apex Court reiterated that the decisions of the academic
authorities should not ordinarily be interfered with by the courts.
Whether a candidate fulfills the requisite qualifications or not is
a matter which should be entirely left to be decided by the
academic bodies and the concerned selection committees, which
invariably consists of experts on the subjects relevant to the
selection.
30. The principles laid down in the decision of the Apex
Court in Dr. Bijayananda Kar [(1994) 1 SCC 169] have no

application on the issue involved in this original petition, which
centers around Condition No.17 of the General Conditions in Part
II, which forms part of Annexure A1 notification dated
31.12.2022 issued by the Kerala Public Service Commission. As
per Condition No.17, a candidate shall be deemed to have
acquired the prescribed educational qualifications only on the
date on which the final result of the course has been declared by
the University/Board concerned. Therefore, the question as to
whether the petitioners-applicants have acquired the prescribed
educational qualifications on or before the last date fixed for
receipt of applications in Annexure A1 notification can be decided
by the Administrative Tribunal, in an application filed under
Section 19 of the Administrative Tribunals Act, 1985, and this
Court can exercise the supervisory jurisdiction under Article 227
of the Constitution of India, when the order passed by the
Tribunal is under challenge in an original petition.
31. In the above circumstances, we find that the
reasoning of the Tribunal in Ext.P1 order dated 18.06.2025 in
O.A.No.1212 of 2024 for declining the reliefs sought for in that
original application is neither perverse nor patently illegal, which
warrants interference in exercise of the supervisory jurisdiction

of this Court under Article 227 of the Constitution of India.
In the result, this original petition fails and the same is,
accordingly, dismissed.
