    1. These D.B. Special Appeals are filed challenging the

    judgment passed by the learned Single Judge, whereby he allowed

    a bunch of writ petitions on 22.02.2023 and held as under:-

    “54. As a result, the instant writ petitions are hereby allowed.
    The impugned office order dated 15.12.2021 issued by the
    RSSB is quashed. Respondent-RSSB is directed to prepare the
    final result on merit for the post of Motor Vehicle Sub-
    Inspector, pursuant to advertisement dated 24.11.2021,
    excluding degree holders in automobile/mechanical
    engineering and the appointment be given by the State as per
    merit list in accordance with law.

    It is made clear that candidate(s) participated in the
    present recruitment process, possessing degree in
    automobile/mechanical engineering, if has/have already
    undergone to the diploma course and had acquired
    qualification of diploma in automobile/mechanical
    engineering, as per the prescribed norms of qualification in the
    advertisement dated 24.11.2021, shall be considered on
    merits. No costs.”

    Facts:-

    2. The facts of the case are that an Advertisement was issued

    on 24.11.2021 by the Rajasthan Staff Selection Board (hereinafter

    referred to as ‘RSSB’) inviting applications for appointment on the

    post of Motor Vehicle Sub-Inspector. An office order was issued

    thereafter on 15.12.2021 by the RSSB enabling the candidates

    possessing higher qualification than the requisite qualification to

    apply and to be treated as eligible to participate in the selection

    process. So far as the Motor Vehicle Sub-Inspector post is

    concerned, the same is to be filed in terms of the Schedule

    appended to the Rajasthan Transport Subordinate Service Rules,

    1963 (hereinafter referred to as ‘the Rules of 1963’) which

    provides as under:-

    Note- It is indicated in the letter of DOP dated 30.08.2022 that the
    Rules of 1963 have been amended vide notification dated 08.03.2018
    and after amendment, the direct recruitment on the post of Motor
    Vehicle Sub Inspector is 100%, instead of 75%. Thus consequently,
    columns No.2, 4 & 5 have been accordingly amended/deleted.

    3. Thus, a candidate as per Clause 7, of the Advertisement

    which was similar to the aforesaid Schedule, was required to

    possess Class 10th qualification and three years Diploma in

    Mechanical Engineering/ Automobile Engineering Course from

    Government of India or State Government or any qualification

    either of the above disciplines declared equivalent by the Central

    Government or State Government. The candidate was further

    required to have one year experience in reputed Automobile

    Workshop for petrol and diesel engine of Light/ Heavy Vehicle and

    repairing. He was further required to possess a Driving License of

    Motorcycle, Heavy Vehicle License and Passenger Vehicle License

    as issued from competent authority. The level of examination was

    mentioned to be that of Secondary/ Technical Diploma.

    4. The writ petitioners filed a writ petition challenging the order

    dated 15.12.2021 issued by the RSSB, whereby, it allowed

    candidates having higher academic qualifications than the three

    year mechanical engineering/ automobile engineering diploma to

    participate in the selection. During the pendency of writ petition,

    the result was declared.

    5. The Department of Personnel (hereinafter referred to as

    ‘DOP’) gave its opinion that persons possessing higher

    qualification are eligible for recruitment on the post of Motor

    Vehicle Sub-Inspector. Vide order dated 03.08.2022, the same

    was therefore, also challenged by the writ petitioners by amending

    the writ petitions.

    6. The appellants who had participated in the selection process

    and cleared the examination were impleaded as respondent Nos.3

    to 8 in one of the Writ Petitions bearing No.382/2022 and a reply

    was filed by them supporting the stand taken by the RSSB as well

    as by the State.

    7. The State Government filed its reply to the writ petition and

    the writ petition was objected on the ground of maintainability

    stating that once the writ petitioners had participated in the

    selection process, they could not have challenged the selection as

    well as the conditions laid down by the RSSB regarding eligibility.

    In support of their decision for allowing candidates having higher

    qualifications, the State in its reply submitted that the

    corrigendum of educational qualification allowing higher

    qualification like B.Tech, M.Tech as eligible qualification for

    applying for the post was in consonance with the provisions of the

    Motor Vehicles Act, 1988 (hereinafter ‘the Act of 1988’) and the

    RSSB had sought guidance from the Department of Higher

    Qualification.

    8. It was further submitted that earlier in the examination of

    Motor Vehicle held in 2013 by the Rajasthan Public Service

    Commission (hereinafter referred to as ‘RPSC’), guidance was

    sought from the Department of Higher Qualification. On

    04.09.2015 it was stated that a higher qualification than three

    year diploma may be considered as sufficient for fulfilling the

    eligibility criteria. It was also stated that even prior to the

    Advertisement of 24.11.2021, candidates having higher

    qualification of degree in Automobile Engineering or Mechanical

    Engineering, were allowed to participate in the selections.

    9. It was further submitted that while there can be a minimum

    qualification laid down under the Rules, as candidates having

    higher qualification cannot be deprived from participation and

    would be therefore eligible to apply.

    10. Section 213(1) of the Act of 1988 empowers the State

    Government to create a Transport Department and appoint

    Officers, as it thinks fit, as Transport Officers. The State

    Government may accept the qualifications or prescribed higher

    qualifications while framing Rules under the proviso to Article 309

    of the Constitution and regarding such existing power, it cannot be

    said that the corrigendum issued to the Advertisement was

    unjustified. They have also relied on the judgment passed in the

    case of S. Satyapal Reddy And Others vs Govt. Of A.P. And

    Others1 wherein the Apex Court held that the State Government

    has the power to prescribe qualifications higher than that laid

    down by the Central Government.

    11. It was further submitted that the degree in Mechanical/

    Automobile Engineering is a higher qualification as compared to a

    three year Diploma in Mechanical and Automobile Engineering and

    would, therefore, be eligible to participate in the selection process.

    The learned Single Judge, however, rejected the argument

    advanced before it. Hence, the present appeals.

    Submissions Of The Parties:-

    12. Learned Senior Counsel for the appellants, along with their

    assisting counsels, made the following submissions:-

    12.1. The Single Bench while deciding the first issue has seriously

    erred in holding that the ratio of the judgment of the Hon’ble

    Supreme Court in the case of S. Satyapal Reddy (supra) would

    have been applicable in the present case only, if the State

    Government itself has prescribed the qualification of Degree in

    Automobile / Mechanical Engineering, as higher qualification and

    eligibility alongwith diploma in Automobile, Mechanical

    Engineering, either in the advertisement dated 24.11.2021 itself

    while initiating recruitment process, or in the statutory rules by

    way of passing separate notifications. In this reference, it is stated

    that the learned Single Judge has failed to consider that the State

    Government, in the past recruitments, also for the post of Motor

    Vehicle Sub Inspector which were conducted through the RPSC

    has informed to treat a higher qualified person as eligible. Thus,

    when such has been the past practice under the same Rules for

    the same post to treat higher qualified persons like degree holders

    in the same faculty Automobile/ Mechanical Engineering as

    eligible, it was not required for the State Government to pass any

    fresh or separate order for the recruitment of 2021 also.

    12.2 The learned Single Judge while deciding the first issue has

    seriously erred in holding that the stand of the State Government

    to treat degree holders in Automobile/ Mechanical Engineering as

    eligible (being higher qualified) cannot be relied upon, because

    during the course of writ petition the DOP has issued a letter

    dated 30.08.2022 and Equivalence Committee has given its report

    dated 14.10.2021 in compliance with directions of this Court vide

    order dated 20.09.2022. When the Commission by virtue of the

    letter dated 04.09.2015 issued by the Department of Transport

    has treated degree holders as eligible for recruitment on the post

    of Motor Vehicle Sub Inspector, the Board has only followed the

    same process by issuance of office order dated 15.12.2021. In

    these circumstances, when by way of a writ petition, a challenge

    was made to the eligibility granted to degree holders for the post

    of Motor Vehicle Sub Inspector being against the qualification

    prescribed under Rule 11 read with Schedule I of the Rules of

    1963. This Court by way of its order dated 03.08.2022, invoking

    Rule 36 of the Rules of 1963 sought opinion from the DOP to this

    effect. The aforesaid letter of the DOP dated 30.08.2022,

    therefore, provides interpretation to the qualification prescribed

    for the post of Motor Vehicle Sub Inspector under the Rules of

    1963 which also allow higher qualified persons as eligible, the

    same was also the past practice in respect to the recruitment of

    Motor Vehicle Sub Inspector as was reflected in the letter dated

    04.09.2015 issued by the Department of Transport.

    12.3 The learned Single Judge while deciding the first issue, has

    also committed an illegality in mis-applying the ratio of the

    judgment of the Hon’ble Supreme Court in the case of Jyoti K.K.

    And Others vs Kerala Public Service Commission And

    Others2, wherein, the controversy before the Hon’ble Supreme

    Court was whether the persons holding Degree in electrical

    engineering can be treated as eligible for holding the higher

    qualification. To answer the aforesaid question, the Hon’ble

    Supreme Court had held that whenever a person acquired higher

    qualification in the same faculty, such qualification can certainly

    stated to presuppose the acquisition of the lower qualification

    prescribed for the post. Therefore, the case of Jyoti K.K. (supra)

    was applicable in the present case, however, in the case of S.

    Satyapal Reddy (supra) the Hon’ble Supreme Court had already

    held that graduation in mechanical engineering is one of the

    higher qualification than diploma in Mechanical Engineering. Even

    in the case of Jyoti K.K. (supra) itself, the Hon’ble Supreme Court

    has held that a degree in electrical engineering has to be treated

    as a higher qualification than Diploma in Electrical Engineering.

    Thus, the gist of the aforesaid judgments in the case of S.

    Satyapal Reddy (supra) and Jyoti K.K. (supra) makes it crystal

    clear that a degree in engineering is a higher qualification than

    diploma in engineering when such degree in engineering is in the

    same faculty as it presupposes acquisition of the lower

    qualification.

    12.4 The learned Single Judge has seriously erred in not relying

    upon the judgment of the Hon’ble Supreme Court in Parvaiz

    Ahmad Parry vs State of Jammu And Kashmir And Others 3,

    it is stated that there is no dispute that diploma in engineering

    and B.Tech in Engineering are two different courses. The dispute is

    whether the degree holders in the same faculty of engineering can

    be treated eligible on the ground of presupposing the acquisition

    of lower qualification of diploma in engineering under the same

    faculty. The Hon’ble Supreme Court in the case of S. Satyapal

    Reddy (supra) while dealing with the case of Motor Vehicle Sub

    Inspector with the qualification of degree in mechanical

    engineering and where the qualification prescribed was diploma in

    Mechanical Engineering and in the case of Jyoti K.K. (supra) for

    recruitment on the post of Sub Engineering Electrical while dealing

    with the case of degree holders in electrical engineering where the

    qualification prescribed was diploma in electrical engineering, has

    already held that degrees shall be treated to be a higher

    qualification than diploma for being in the same faculty.

    12.5 The learned Single Judge has seriously erred in holding that

    judgment of the High Court of Jammu and Kashmir in the case of

    S. Gurmeet Singh And Others vs State And Others. 4 was not

    covering the facts of the present case and judgment was given in

    the peculiar facts of that case alone even when the High Court of

    Jammu & Kashmir was dealing with same controversy for the post

    of Motor Vehicle Sub Inspector in respect to the eligibility to the

    degree holders in Automobile/ Mechanical Engineering when the

    advertisement prescribed qualification only of diploma in

    Automobile/ Mechanical Engineering as eligibility. Hence, the

    impugned judgment dated 22.02.2023 passed by learned Single

    Judge deserves to be quashed and set aside.

    12.6 The learned Single Judge has seriously erred in not relying

    upon judgment of the Apex Court in the case of Puneet Sharma

    And Others vs Himachal Pradesh State Electricity Board

    Limited And Another5, even when in the aforesaid judgment

    candidates possessing degree in the same faculty were held to be

    eligible.

    12.7 The learned Single Judge has seriously erred in relying upon

    judgments of the Full Bench of Allahabad High Court in the case of

    Deepak Singh vs State of U.P.6 and Abhishek Sharma And

    Others vs State of U.P. And Others7 wherein the Court has

    relied upon the case of Zahoor Ahmad Rather And Others vs

    Sheikh Imtiyaz Ahmad And Others8 for the reason that like in

    the State of Allahabad, in the State of Jammu & Kashmir also in

    the case of Zahoor Ahmad Rather (supra), it was held that it is

    the employers right to adjudge the eligibility. Thus, the ratio of the

    judgment in the case of Zahoor Ahmad Rather (supra) was that

    it is the State who has to decide the eligibility and the powers of

    judicial review cannot be exercised. When the aforesaid issue is

    applied in the present case, as the State has treated higher

    qualified persons as eligible, therefore, the case of Deepak Singh

    (supra) and Abhishek Sharma (supra) could not have been

    applied in the present matter.

    12.8 The learned Single Judge while deciding the second issue has

    erred in holding that it would not be permissible for the Court to

    draw an inference that higher qualification necessarily

    presupposes the acquisition of another, albeit lower qualification

    and it is not part of the role or function of judicial review to

    expand upon the ambit of the prescribed qualification. It is

    pertinent to mention here that the appellants never pleaded

    before learned Single Judge to draw an inference that higher

    qualification presupposes the acquisition of another. On the

    contrary, the State Government in past recruitments (also for the

    post of Motor Vehicle Sub Inspector which were conducted through

    RPSC), has informed the RPSC to treat higher qualified person as

    eligible. Thus, when such has been the past practice under the

    same Rules for the same post to treat higher qualified persons like

    degree holders in the same faculty of Automobile/ Mechanical

    Engineering as eligible, it was not required to draw any inference.

    12.9 The learned Single Judge while deciding the second issue has

    erred in not relying upon the expert committee report dated

    14.10.2022. The learned Single Judge has not appreciated the fact

    that the learned Single Judge considering the submissions made

    by learned counsel for the petitioners directed the Secretary, DOP

    to place the matter before the Equivalence Committee to be

    constituted in pursuance to the circulars dated 18.10.2021 with

    regard to eligibility of candidates who are having degree of

    Mechanical/ Automobile Engineering for appointment on the post

    of Motor Vehicle Sub Inspector. The Equivalence Committee

    submitted its report to the effect that candidates possessing

    degree in Automobile/ Mechanical engineering are eligible for the

    post of Motor Vehicle Sub Inspector.

    12.10 The learned Single Judge while deciding the second issue

    has erred in holding that the ratio of judgment in the case of

    Zahoor Ahmad Rather (supra) stands in favour of diploma

    holders as in DOP letter dated 30.08.2022 as well as in report

    dated 14.10.2022 submitted by the Equivalence Committee, there

    is no finding to the effect that a degree in automobile/ mechanical

    engineering necessarily presupposes the acquisition of the

    qualification of diploma in the same discipline and there is no

    finding that degree should be treated as equivalent to the diploma

    in the discipline of automobile / mechanical engineering. The ratio

    of the judgment in the case of Zahoor Ahmad Rather (supra)

    was that it is the State who has to decide the eligibility and the

    powers of judicial review cannot be exercised and when the

    aforesaid issue is applied in the present case, the State has

    treated higher qualified persons holding the qualification of Degree

    in Automobile /Mechanical Engineering as eligible.

    12.11 The learned Single Judge while deciding the second issue

    has erred in holding that the rules of the game cannot be changed

    midway in the selection process. Once it has started, the letter

    dated 30.08.2022 of DOP cannot be made applicable to the

    present process of recruitment of Motor Vehicle Sub Inspector. The

    aforesaid letter of the DOP dated 30.08.2022, therefore, provides

    interpretation regarding the qualification prescribed for the post of

    Motor Vehicle Sub Inspector under the Rules of 1963 which also

    allows higher qualified persons to be eligible which was also the

    past practice in respect to the recruitment of Motor Vehicle Sub

    Inspector as was reflected in the letter dated 04.09.2015 issued

    by the Department of Transport and thus, the learned Single

    Judge committed an error in holding that the rules of game have

    been changed after it has started.

    12.12 The learned Single Judge while deciding the second issue

    has erred in holding that the ratio of Ajith K. And Others vs

    Aneesh K.S. And Others9, shall be applicable to the facts of the

    present case. The aforesaid case shall not be applicable as in the

    instant case there has been determination of equivalence by the

    Expert Committee formed by the learned Single Judge on the

    application moved by private respondents. Also, private

    respondents have not challenged the order dated 15.12.2021 on

    14. Per contra, learned Senior Counsel for the respondents-writ

    petitioners, along with their assisting counsels, made the following

    submissions:-

    14.1 The selection process for 197 posts of Motor Vehicle Sub-

    Inspector was initiated vide Advertisement dated 24.11.2021. The

    office order dated 15.12.2021 (issued by the RSSB), enabling the

    candidates possessing higher qualification than the requisite

    qualification, was challenged by the diploma holders (writ

    petitioners).

    14.2 Rule 11 of the Rules of 1963 deals with academic and

    Technical qualification which does not postulate that candidates

    who do not have basic qualification would be eligible.

    14.3 There is no provision in the Rules of 1963 to consider degree

    in Automobile/ Mechanical Engineer as presupposing lower

    qualification. It is stated that the State Government has not

    chosen to amend the Rules of 1963 which have been framed in

    exercise of powers conferred by proviso to Article 309 of the

    Constitution of India and no amendment could have been

    prescribed by an administrative order which runs contrary to the

    statutory rules.

    14.4 The Rules do not postulate the qualification as minimum

    qualification and therefore, the qualification prescribed under the

    schedule is the only qualification and no other qualification can be

    construed higher or equivalent contrary to the rules. Therefore,

    the order dated 15.12.2021 basically changed the rules of game.

    14.5 The RSSB, being nodal agency to conduct the examination,

    could not have altered the qualifications on its own as prescribed

    by the statutory rules. Thus, the impugned order dated

    15.12.2021 was beyond the competency and authority of the

    RSSB.

    14.6 The inter-departmental communication in the previous

    recruitment cannot be construed as equivalence of qualification, as

    mandated under the Rules, as the Transport Department was not

    competent to declare any qualification as higher or equivalent.

    16. Learned counsel for the respondents-writ petitioners Mr. M.F.

    Baig has submitted that during the pendency of the writ petition,

    the learned Single Judge passed an order relying on Rule 36 of the

    Rules of 1963 and referred the matter to the DOP seeking their

    opinion as to whether persons having higher educational

    qualification, i.e., Degree in Mechanical Engineering are eligible to

    apply for the post of Motor Vehicle Sub-Inspector under the Rules

    of 1963. In compliance of the order dated 03.08.2022, the DOP

    gave its opinion to the RSSB vide their communication dated

    30.08.2022 with regard to the persons having Degree of

    Mechanical Engineering and Automobile Engineering to be eligible

    and the learned counsel for the writ petitioner submitted that such

    an opinion given by the DOP could not be taken into consideration

    as the correct opinion and a circular had been issued by the State

    Government on 18.10.2021 to the effect that in case of any

    dispute regarding educational qualification, it would be the

    Committee which would decide the matter, whereas, only the Joint

    Secretary had given their opinion. The learned Single Judge,

    therefore, directed to place the matter before the Equivalence

    Committee constituted in pursuance of circular dated 18.10.2021.

    17. Learned counsel has further submitted that the Experts/

    Equivalence Committee gave its opinion on 14.10.2022, stating

    that it was neither rational nor justified to exclude the candidates

    holding a higher qualification than the diploma holders in the same

    discipline as ineligible (holding the qualification of degree in the

    subject of Mechanical Engineering and Automobile Engineering to

    be a higher qualification). The DOP also directed that such

    candidate possessing the qualification shall be treated to be higher

    qualification and candidates possessing such qualification would be

    eligible to participate. He further pointed out that subsequently,

    even an amendment has been made and now candidates having

    higher qualification are also treated as eligible under the Rules.

    18. It was also further pointed out that even in the previous

    recruitment examination of Motor Vehicle Sub Inspector, directions

    were issued allowing the candidates, who possess higher

    educational qualification than the prescribed educational

    qualifications, to be treated as eligible and therefore, there was no

    reason to depart from the settled principles.

    19. Learned counsel Mr. M.F. Baig, therefore, supports the

    judgment passed by the learned Single Judge and reiterates his

    submissions made before the learned Single Judge in support of

    the prayer made of excluding the degree holders.

    20. Learned counsel Mr. M.F. Baig also adopts the arguments as

    raised by learned Senior Counsel Mr. Ajeet Kumar Sharma.

    21. Learned counsel Mr. Sunil Samdaria has also supported the

    judgment passed by the learned Single Judge.

    22. The other counsels have also supported the judgment passed

    by the learned Single Judge and pointed out that even the report

    of the Expert Committee whereby the directions were issued, did

    not hold the qualification of degree in Automobile Engineering and

    Mechanical Engineering to be equivalent to diploma and merely

    directed that since it was a higher qualification, the same can be

    considered.

    23. We have considered the submissions and carefully gone

    through the judgment passed by the learned Single Judge and

    also the judgments which have been cited at Bar.

    24. Before we examine the merits of the case, it would be

    apposite to discuss in short the import of the judgments cited at

    Bar by both the learned counsels for the parties.

    25. In the case of Jyoti K.K. (supra), the appellants-therein

    were holders of B. Tech degree in Electrical Engineering, who were

    held to be ineligible for selection on the post of Sub-Engineers

    (Electrical) which provided the technical qualification of Diploma in

    Electrical Engineering of a recognized Institution after 3 years’

    course of study or a certificate in Electrical Engineering from any

    one of the recognized Technical Schools. The contention was that

    since they possess higher qualification, therefore, their non-

    consideration was not correct.

    The Supreme Court further noticed that the rules governing

    the appointment also provided under Rule 10(a)(ii), a non-

    obstante clause which states that “notwithstanding anything

    contained in the rules such of those higher qualifications which

    presuppose the acquisition of the lower qualification prescribed for

    the post shall also be sufficient for the post.”

    The Supreme Court also noticed that for the promotional

    post of Assistant Engineer, a degree in Electrical Engineering has

    been prescribed and therefore, it proceeded to hold that for a

    higher post as the qualification of degree is provided, it would be

    pre-supposing that the acquisition of lower qualification of diploma

    in that subject prescribed for the post should be sufficient.

    26. In the case of Zahoor Ahmad Rather (supra), the post of

    Technician Grade-III was in question and qualification prescribed

    was Matriculation with the ITI in Electrical Grade. The appellants-

    therein were diploma holders in Electrical Engineering/ Electronics

    and Communication but did not possess ITI certification. The Apex

    Court held as under:-

    “26. We are in respectful agreement with the
    interpretation which has been placed on the
    judgment in Jyoti K.K. in the subsequent
    decision in Anita. The decision in Jyoti K.K.
    turned on the provisions of Rule 10(a)(ii).
    Absent such a rule, it would not be permissible
    to draw an inference that a higher qualification
    necessarily presupposes the acquisition of
    another, albeit lower, qualification. The
    prescription of qualifications for a post is a
    matter of recruitment policy. The State as the
    employer is entitled to prescribe the
    qualifications as a condition of eligibility. It is
    no part of the role or function of judicial review
    to expand upon the ambit of the prescribed
    qualifications. Similarly, equivalence of a
    qualification is not a matter which can be
    determined in exercise of the power of judicial
    review. Whether a particular qualification
    should or should not be regarded as equivalent
    is a matter for the State, as the recruiting
    authority, to determine. The decision in Jyoti
    K.K. turned on a specific statutory rule under
    which the holding of a higher qualification
    could presuppose the acquisition of a lower
    qualification. The absence of such a rule in the
    present case makes a crucial difference to the
    ultimate outcome. In this view of the matter,
    the Division Bench of the High Court was
    justified in reversing the judgment of the
    learned Single Judge and in coming to the
    conclusion that the appellants did not meet the
    prescribed qualifications. We find no error in
    the decision of the Division Bench.

    27. While prescribing the qualifications for a
    post, the State, as employer, may legitimately
    bear in mind several features including the
    nature of the job, the aptitudes requisite for
    the efficient discharge of duties, the
    functionality of a qualification and the content

    of the course of studies which leads up to the
    acquisition of a qualification. The State is
    entrusted with the authority to assess the
    needs of its public services. Exigencies of
    administration, it is trite law, fall within the
    domain of administrative decision-making. The
    State as a public employer may well take into
    account social perspectives that require the
    creation of job opportunities across the societal
    structure. All these are essentially matters of
    policy. Judicial review must tread warily. That
    is why the decision in Jyoti K.K. must be
    understood in the context of a specific
    statutory rule under which the holding of a
    higher qualification which presupposes the
    acquisition of a lower qualification was
    considered to be sufficient for the post. It was
    in the context of specific rule that the decision
    in Jyoti K.K. turned.”

    27. We notice that the case of Jyoti K.K. (supra) was also

    distinguished by the Apex Court in the case of Anita (supra). In

    that case [Anita (supra)], the qualification for J.B.T. Teacher

    required a Matric with two years course in J.B.T. Training with

    knowledge of Punjabi and Hindi language at matriculation

    standard or its equivalent. The respondents-therein had held

    qualification of M.A/ M.Sc. and aiming it to be a higher

    qualification, sought participation and eligibility for the post of

    J.B.T. Teacher. However, the Hon’ble Supreme Court disallowed

    such participation and distinguished Jyoti K.K. (supra), noticing

    the existence of Rule 10(a)(ii) in the Kerala State and Subordinate

    Services Rules, 1956, which was absent in Anita‘s Case (supra).

    It would be apposite to quote the relevant para 15 of the

    judgment passed in the case of Anita (supra) as under:-

    “15. It was sought to be asserted on the basis
    of the aforesaid observations, that since the
    private respondents possess higher
    qualifications, then the qualification of JBT/ETT,

    they should be treated as having fulfilled the
    qualification stipulated for the posts of JBT/ETT
    Teachers. It is not possible for us to accept the
    aforesaid submission of the learned counsel for
    the private respondents, because the statutory
    rules which were taken into consideration by
    this Court while recording the aforesaid
    observations in Jyoti K.K. case, permitted the
    aforesaid course. The statutory rule, in the
    decision relied on by the learned counsel for the
    private respondents, is extracted hereunder:

    (SCC p.598, para 6)

    “6. Rule 10(a)(ii) reads as follows:

    ’10.(a)(ii) Notwithstanding anything
    contained in these Rules or in the Special
    Rules, the qualifications recognised by
    executive orders or Standing Orders of
    Government as equivalent to a qualification
    specified for a post in the Special Rules and
    *such of those higher qualifications which
    presuppose the acquisition of the lower
    qualification prescribed for the post shall
    also be sufficient for the post*.’ ” (emphasis
    supplied)

    A perusal of the Rule clearly reveals that the
    possession of higher qualification would
    presuppose the acquisition of the lower
    qualification prescribed for the posts. Insofar as
    the present controversy is concerned, there is
    no similar statutory provision authorising the
    appointment of persons with higher
    qualifications.”

    28. A recent judgment in the case of Puneet Sharma (supra),

    the Apex Court was considering the qualification required for

    appointment and the question as to whether a degree in Electrical

    Engineering/Electrical and Electronics Engineering is technically a

    higher qualification than a diploma in that discipline and whether

    degree holders are eligible for appointment to the post of Junior

    Engineer (Electrical). In the said case, a rule which was mentioned

    in the Schedule as “Minimum educational and other qualifications

    required to direct recruits” and it was stated that the essential

    qualification is minimum matriculation with diploma in Electrical/

    Electronics and Communication/ Computer Sciences. Considering

    the word ‘minimum’ the Court proceeded to hold that a higher

    qualification would also be sufficient. By reading the Rule as a

    whole, it proceeded to held as under:-

    “33. This Court is conscious that the issue in
    question is whether the minimum qualification of a
    diploma in electrical or electronic engineering or
    other prescribed qualifications includes a degree in
    that discipline. However, the rules have to be
    considered as a whole. So viewed, the two sub-
    quotas are:

    (1) 5% enabling those diploma-holders who
    acquire degree qualifications during service as
    Junior Engineers; and
    (2) 5% enabling among those who hold degrees
    before joining as Junior Engineers.

    34. The latter (2) conclusively establishes that
    what the rule-making authority undoubtedly had in
    mind was that degree-holders too could compete
    for the position of JEs as individuals holding
    equivalent or higher qualifications. If such
    interpretation were not given, there would be no
    meaning in the 5% sub-quota set apart for those
    who were degree-holders before joining as Junior
    Engineers — in terms of the recruitment rules as
    existing.

    35. The court’s opinion is fortified by the latest
    amendment brought about on 3-6-2020. This
    clarifies beyond doubt that even for the post of
    Junior Engineers, those individuals holding higher
    qualifications are eligible to compete. In the
    opinion of this Court, though the amending rules
    were brought into force prospectively,
    nevertheless, being clarificatory, they apply to the
    recruitment that is the subject-matter of the
    present controversy. Such a position (i.e.
    clarificatory amendments operative retroactively,
    despite their enforcement prospectively) has been
    held in several previous judgments of this Court. In
    Zile Singh v. State of Haryana this Court examined
    the various authorities on statutory interpretation
    and concluded:(SCC pp. 8-9, paras 13-14)

    “13. It is a cardinal principle of construction
    that every statute is prima facie

    prospective unless it is expressly or by
    necessary implication made to have a
    retrospective operation. But the rule in
    general is applicable where the object of
    the statute is to affect vested rights or to
    impose new burdens or to impair existing
    obligations. Unless there are words in the
    statute sufficient to show the intention of
    the legislature to affect existing rights, it is
    deemed to be prospective only–‘nova
    constitutio futuris formam imponere debet
    non praeteritis’–a new law ought to
    regulate what is to follow, not the past.
    (See Principles of Statutory Interpretation
    by Justice G.P. Singh, 9th Edn., 2004 at p.

    438.) It is not necessary that an express
    provision be made to make a statute
    retrospective and the presumption against
    retrospectivity may be rebutted by
    necessary implication especially in a case
    where the new law is made to cure an
    acknowledged evil for the benefit of the
    community as a whole (ibid., p. 440).

    14. The presumption against retrospective
    operation is not applicable to declaratory
    statutes…. In determining, therefore, the
    nature of the Act, regard must be had to
    the substance rather than to the form. If a
    new Act is “to explain” an earlier Act, it
    would be without object unless construed
    retrospectively. An explanatory Act is
    generally passed to supply an obvious
    omission or to clear up doubts as to the
    meaning of the previous Act. It is well-
    settled that if a statute is curative or
    merely declaratory of the previous law
    retrospective operation is generally
    intended…. An amending Act may be purely
    declaratory to clear a meaning of a
    provision of the principal Act which was
    already implicit. A clarificatory amendment
    of this nature will have retrospective effect
    (ibid., pp. 468-69).””

    29. It is settled law that the State as an employer is entitled to

    prescribe the qualification required to be held by any person for

    appointment on any post. The said qualification would be

    incorporated in the rules framed under the proviso to Article 309

    of the Constitution of India.

    30. Having considered the aforesaid and detailed discussions in

    the judgment passed by the learned Single Judge, we find that the

    schedule as noticed above reflects a completely different picture.

    For the post of Motor Vehicle Sub-Inspector, there is no word

    ‘minimum qualification’ mentioned, as specific qualification of

    Diploma in Automobile Engineering or a Diploma in Mechanical

    Engineering has been stated. Any qualification in either of the

    above disciplines declared equivalent by the Central Government

    or the State Government has also been treated as eligible. Thus,

    consciously the Rule making authority did not add the words

    ‘higher qualification’ nor it added ‘degree holders’ for the post.

    31. The Equivalence Committee also consciously did not equate

    diploma with degree. Thus, what the appellants want this Court to

    do, is to add a qualification in the Schedule, which is absent. It is

    a settled principle of law that the rules have to be given the

    meaning for which they have been framed. So far as the higher

    qualification part is concerned, while we agree that the degree in

    the Automobile Engineering may be a higher qualification, but if

    the post is meant for those who are doing diploma, essentially

    what we find is that the legislature intended to give a source of

    employment to those who have done diploma alone and not to

    those who have done degree in a subject. As held in Zahoor

    Ahmad Rather‘s Case (supra), we would refrain from adding

    something more than what the Rule making Authority intended

    nor we can expand the canvass of qualification.

    32. While exercising the writ jurisdiction, the judgment passed

    by the learned Single Judge, therefore, does not warrant any

    interference.

    33. Although, the State Government may have later on amended

    the rule, the same would be made effective from the date of

    coming into force of the amendment and does not apply to an

    advertisement which has already been issued. It is settled law that

    the rules of game cannot be allowed to be changed after the game

    has already started. Reference in this regard is made to the

    decision of the Apex Court in the case of Tej Prakash Pathak

    And Others vs Rajasthan High Court And Others38.

    34. In view of the above discussion, the appeals are dismissed.

    35. The interim order stands vacated. The respondent-State shall

    now proceed with the selection and the same shall be concluded

    forthwith.

    36. All pending applications stand disposed of accordingly.

    37. A copy of this judgment be placed in each connected matter.
