1. The present writ petition has been taken up upon urgent mentioning at
1:00 PM today.
2. The petitioner seeks a direction to the respondent/MCD, restraining
MCD from taking any action in respect of the property bearing no. C-28,
Shanti Kunj, Farm No. 5, Khasra No. 45/2/2 min, situated in revenue estate
of Village Mehrauli, Tehsil Mehrauli, New Delhi (hereinafter ‘subject
property’), without following due process of law. The petitioner claims
ownership in the subject property vide sale deed dated 16th August, 2021.
3. It is contended on behalf of the petitioner that the subject property is a
part of the 1511 unauthorized colonies that are to be regularized under the
PM-UDAY Scheme on an ‘as is where is’ basis with a cutoff date of 6th
April, 2026 for residential use.
4. The petitioner has applied for regularization under the said scheme on
20th May, 2026.

5. Issue notice.
6. Notice is accepted by Mr. Kapil Dutta, Standing Counsel appearing
on behalf of the respondent/ MCD.
7. He submits that the subject property was booked for unauthorized
construction on 8th May, 2026 and a work stop notice was issued on 12th
May, 2026. Despite the same, the petitioner continued with the construction
activity. He further submits that as per the Sale Deed, the subject property
was in the nature of an agricultural land, where no construction could be
carried out.
8. Counsel for the respondent/MCD submits that a sealing show cause
notice was issued by the respondent/ MCD on 18th May, 2026 and the same
was pasted at the subject property on 19th May, 2026. He submits that the
subject property has been sealed today in pursuance to a sealing order.
9. Counsel for the petitioner contests that no sealing order has been
passed by the respondent/ MCD.
10. Let the sealing order be supplied to counsel for the petitioner during
the course of the day.
11. In view of the aforesaid the present writ petition stands disposed of.
12. It is made clear that this Court has not made any observation with
regard to the merits of the case.
13. Needless to state the petitioner would be entitled to invoke available
remedies that are available in law.

15. In the event, any demolition order is passed against the subject
property, copy of the same shall be provided immediately to the counsel for
