Mr. D.C.S. Rawat, learned counsel for
the applicant.
2. Mr. Dinesh Chauhan, learned A.G.A. for
the State.
3. The applicant – Raj Kumar, who is in
judicial custody in connection with FIR/Case
Crime No. 05 of 2026, under Sections
8/20/29/60 of NDPS Act, registered at P.S.
Laxmanjhoola, District Pauri Garhwal, has
sought his release on bail.
4. In this case, applicant was apprehended
alongwith the co-accused on 01.03.2026 at
about 04:10 PM and a recovery of 1.4 Kg of
charas was recovered from the tool box of the
motorcycle in which the applicant was a pillion
rider.
5. Learned counsel for the applicant would
submit that applicant has falsely been
implicated in the case; that neither he was the
owner of the motorcycle nor was he riding the
motorcycle; that he had no knowledge about
the contraband kept in the tool box of the
motorcycle as he was just the pillion rider in it
and that applicant has no previous criminal
history.
6. Per contra, learned State has
vehemently opposed the bail application.
7. Considering the fact that recovery of the
alleged charas was made from the tool box of
the motorcycle and not from the applicant and
the applicant was just a pillion rider in the
motorcycle, this Court is of the view that it is
a case fit for bail and the applicant deserves
to be enlarged on bail.
8. The bail application is allowed.
9. Let the applicant be released on bail, on
his executing personal bond and furnishing
two reliable sureties, each of like amount, to
the satisfaction of Court concerned, subject to
the following conditions:-
(a) The applicant shall not leave the country
without prior permission of the court.
(b) The applicant shall appear before the
investigating officer as and when required and
cooperate with the investigation.
(c) The applicant shall not tamper with
evidence or witnesses, either directly or
indirectly and shall not indulge in any criminal
activity while on bail.
(d) The applicant shall surrender his passport, if
any, to the court or to the investigating agency,
to preclude risk of absconding.
10. The bail granted to the applicant shall be
liable to be cancelled in the event of any
violation of the aforesaid conditions or if the
applicant is found to have misused the liberty
granted to him.
