Heard learned counsel for the petitioner and learned
APP for the State. Although notices have been validly served
upon O.P. No. 2, there is no representation on his/her behalf.
2. The petitioner has preferred this application for
grant of regular bail in connection with Morkahi P.S. Case No.
68 of 2024 registered for the offences punishable under Sections
341, 342, 363, 365, 379, 504, 506/34 of the IPC.
3. As per the prosecution case, the minor sister of the
informant was going to ‘basa’, and in the meantime, the
petitioner along with other named accused persons, armed with
lethal weapons, under a conspiracy, forcibly kidnapped the sister
of the informant. It is further alleged that the petitioner along

with Puja Kumari, at gunpoint, pulled the victim into a Bolero
vehicle, made her sit inside, and fled away. It is further alleged
that after a hectic search, the victim was recovered from the
matrimonial house of the sister of the petitioner, and thereafter
she was taken back to her home. It has also been alleged that the
minor sister of the informant was abused and assaulted, and a
gold chain worth Rs. 1,00,000/- and earrings worth Rs. 30,000/-
were snatched from her possession.
4. Learned counsel for the petitioner has submitted
that the petitioner is innocent and has falsely been implicated in
this case. It has further been submitted that the petitioner and the
victim were in a love relationship and the victim voluntarily
joined the company of the petitioner. It has further been
submitted that there is no allegation that the police recovered the
victim, rather, prior to the registration of the FIR, the victim was
brought back to her house. It has further been submitted that the
statement of the victim recorded under Section 183 of the
B.N.S.S., which was called for by the order dated 09.10.2025,
indicates that no rape was committed, and only an attempt to
commit rape was made. It has further been submitted that the
charge sheet has been filed in this case under Section 341, 342,
363, 379, 376, 511, 120B of the IPC and Section 8 of the
Patna High Court CR. MISC. No.70860 of 2025(7) dt.05-05-2026

POCSO Act. As per the report of the trial court only charges
have been framed and hence in view of the Section 35 of the
POCSO Act the trial is likely to be not concluded in near future.
Lastly, it has been submitted that the petitioner has got clean
criminal antecedent and is in custody since 27.11.2024.
5. Learned APP for the State has vehemently opposed
the prayer for bail of the petitioner.
6. Heard the parties and perused the record, the
petitioner above-named is directed to be enlarged on bail on
furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand)
with two sureties of the like amount each to the satisfaction of
learned Court concerned, Khagaria, in connection with Morkahi
P.S. Case No. 68 of 2024.
