1. Heard Mr. H.R. Nath, learned counsel for the petitioner, who has
submitted that an FIR dated 07.04.2026 was lodged before the Officer
Incharge, Shahlang Police Station by the two complainants, who has
alleged that their minor daughters respectively have been sexually
assaulted by the two persons also named in the FIR

2. Accordingly, the FIR was registered as Shahlang P.S. Case No. 7
(4)2026 u/s 5 (g)/6 of the POCSO Act.

3. It is the submission of the learned counsel that the petitioner herein
is not involved in the alleged incident, but was only involved to the extent
that the two accused persons have called him on the said date when the
incident is said to have been happened, ie. 07. 04. 2026 requesting him to
drop the two minor girls to their respective home, which he has done so.

4. However, the petitioner, in view of the registration of the said FIR is
apprehending arrest in connection with the said case that is, Shahlang P.S
case No. 7 (4) 2026 and has accordingly approached this Court with a
prayer for grant of pre arrest bail.

5. The learned counsel has further submitted that an application for
grant of pre arrest bail has already been made before the Special Judge
POCSO, West Khasi Hills District, which was rejected vide order dated 20.

04. 2026.

6. Mr. S. Sheikh, learned GA has entered appearance on behalf of the
respondent Nos. 1,2 and 3.

7. Th two complainants have also been arrayed as party respondent
herein, being respondent No. 4 and 5 respectively.

8. At the outset before this matter is heard on merits, the petitioner is
directed to issue notice upon the two respondents i.e. 4 and 5, the same to
be done through the IO, who will file his cokpliance report.

9. The prosecution is also directed to produce copy of the CD on the
next date fixed as well as the latest status report.

10. List this matter on 7th May, 2026.

11. In the meantime, as prayed for, the petitioner is allowed to go on
interim bail on condition that he shall not abscond or tamper with the
evidence and shall also cooperate with the IO as and when required.

12. Ordered accordingly.
