Heard Mr. S.S. Yadav, learned counsel for the petitioner, who has
submitted that this is an application for grant of bail on behalf of her husband
(Shri. Bhuban Deb) who was arrested in connection with Lumshnong PS Case
No.29(11)2025, under Section 8(c)/21(b)/25 and 29 of the NDPS Act.

Apart from other grounds, the learned counsel for the petitioner has mostly
relied on the fact that the accused person in question has not been made known
of the grounds of arrest, inasmuch as, the same has not been furnished to him in
the language known to him, and instead, the communication was in English,
which is not known to him. As such, the constitutional mandate of Article 22(1)
of the Constitution of India has been violated. Submits the learned counsel.

Mr. R. Gurung, learned GA, has appeared on behalf of the State
respondent. It is the submission of the learned GA, that the case diary
particularly, the observations made by the Investigating Officer (I/O) at the time
when the said grounds of arrest was communicated to the accused person may
be called for.

On consideration of the submission made, this court directs the I/O to
produce the case diary on the next date fixed.
