1. Heard.
2. The dispute has arisen between the parties and the
petitioner seek appointment of an Arbitrator to adjudicate the
same. The partnership deed was executed between the father of
the petitioner and the respondents. Father of the petitioner
expired on 29.04.2021. Earlier the petitioner filed a civil suit,
which was dismissed on 20.04.2022 on the basis that there is an
arbitration clause and the civil suit would not lie. Thereafter, the
application under Section 9 of the Arbitration and Conciliation Act,
1996 (for short the ‘the Act of 1996’) was filed, wherein order has

been passed on 05.08.2025, whereby the application under
Section 9 of the Act has been dismissed. Thus, it is clear that the
petitioner wants to raise certain disputes before the Arbitrator with
regard to the rendition of the accounts of the firm.
3. This Court, with the consent of learned counsel for the
parties, appoints Mr. Ayub Khan (Retd. District Judge), R/o-130,
Sanjay Nagar-B, Jhotwara, Jaipur-302012 to act as Sole Arbitrator
and to decide all issues without prejudice to the rights and
contentions raised in the present application. The arbitration fees
shall be determined in accordance with the Fourth Schedule of the
Arbitration & Conciliation Act, 1996 (hereinafter referred to as ‘the
Act of 1996’), as amended. The fee of the Arbitrator will be
equally borne by both the parties. The place of arbitration shall be
at Jaipur.
4. The Arbitrator is requested to complete the proceedings as
per time limit specified under Section 29A of the Act of 1996.
5. The arbitration application is allowed accordingly.
6. Copy of this order be sent to the appointed Sole Arbitrator.
