    1. Heard learned counsel appearing for the parties.

    2. Sub-inspector, Babu Ram is present in person. He has produced the

    case diary, a perusal whereof reveals that a complaint for commission of

    offences punishable under Sections 8, 21, 25, 27A, 29 and 60 of the

    NDPS Act stands filed against Abdul Razzaq, Gafoor Ali and Juman Din.

    Abdul Razzaq is the petitioner in this Bail application.

    3. Though the quantity of the contraband allegedly recovered from the

    accused persons falls within the category of intermediate quantity but

    taking into consideration that Section 27A of NDPS Act has been imposed

    and learned Additional Sessions Judge, Samba, (hereinafter to be referred

    as “the trial court), has yet to form its opinion as to whether offence under

    Section 27A of NDPS is made out or not, this bail application is disposed

    of with a liberty to the petitioner to approach the learned trial Court for

    grant of bail after the order on charge/discharge is passed by the learned

    trial Court.
