1. After hearing the counsel for the petitioners, it was brought to the
notice of this Court that the FIR lodged by the petitioners being case
FIR No. 18/2023 of P/S Khansahib, Budgam under Sections 147,
148, 447, 307 and 506 IPC has already concluded into the charge-
sheet whereas in the impugned FIR, the respondent No. 2 alleges that
the petitioners had formed an unlawful assembly and thereafter
attacked the respondent No. 2, whereas admittedly at the time of the
alleged incident (the one stated by respondent No. 2), petitioners
were in Hospital undergoing treatment after they were attacked by
the respondent No. 2 and her companions. It is, therefore, submitted
that record of the case FIR No. 18/2023 be summoned since the same
has concluded into the charge-sheet that charge-sheet, as per the
parties, is pending before the Court of Additional Sessions Judge,
Budgam.
2. Send for the scanned copy of the case record arising out of case FIR
No. 18/2023.
3. List for consideration on 02.06.2026.
