UPON hearing the counsel the Court made the following
O R D E R
1. Against order of rejection of regular bail by the High Court
and to seek bail, the present special leave petition has been
filed. The petitioner is in custody from 07.08.2021 in connection
with FIR No.54/2021 dated 17.05.2021 for the offences punishable

Reason: Sections 302, 120(B), 34, 364 of Indian Penal Code and
Sections 3, 4, 25, 7/27 of Arms Act, registered with Nanded Police
Station, Maharashtra.
2. After hearing learned counsel for the parties, it is found
that the petitioner is in custody since 07.08.2021 and at present,
the trial of the present offence has been stayed because the trial
under the Maharashtra Control of Organised Crime Act, 1999– MCOC
Act is to be concluded first.
3. Nothing is brought on record to indicate that how much time
the MCOC Act trial may take. However, in absence of any cogent
material, keeping the petitioner in custody without any reason due
to delay in trial, we deem it appropriate to release the petitioner
on bail.
4. Accordingly, we direct to release the petitioner on bail on
furnishing the suitable bail bonds and sureties and on such other
terms and conditions as may be deemed fit by the trial Court.
5. Petitioner to abide all the conditions as imposed and shall
regularly attend the trial until exempted by the Court. Violation,
if any, may give a cause to take recourse as permissible and the
trial Court is at liberty to do the needful.
6. Accordingly, and in view of the foregoing, the special leave
petition stands allowed. Pending application(s), if any, shall
stand disposed of.
