1. This hearing has been done through hybrid mode.
2. The present matter was listed on 03.03.2026. On account of 03.03.2026
being declared as a holiday vide notification no. 64/G-4/Genl.-I/DHC dated
27.02.2026, the same is being taken up for hearing today.
3. The present petition under Section 24 of the Code of Civil Procedure,
1908, (for short, ‘CPC‘), seeks the following prayers: –
“It is, therefore, most respectfully prayed that this Hon’ble Court may
kindly be pleased to allow the present application and pass necessary
orders for transfer of the Civil Suit bearing CS(Comm) no.105/2021
titled as “Robin Kumar Jaiswal Vs. Sunny Singhal, which is pending
disposal in the court Sh.Gorakh Nath Pandey, District Judge (Comm.
Court), Distt. North, Rohini Courts, Delhi, now fixed for 1.11.2024 to
the court of Sh.Mayank Goel, Ld.ASCJ, Distt. West, Tis Hazari
Courts, Delhi for consolidation with the civil suit bearing CS SCJ
no.61/21 titled as Sunny Singhal Vs. Robin Kumar Jaiswal, now fixed
for 11.3.2024 and both the said suits may be ordered to be tried and
decided together accordingly, in the interest of justice.

Pass any other order or relief which this Hon’ble Court under the facts
and circumstances of the case may deem fit and proper in favour of
the applicant/Petitioner and against the Respondent.”
4. The present petition is filed on behalf of the petitioner seeking transfer
of commercial suit instituted by the present respondent being CS (Comm)
No. 105/2021, titled as “Robin Kumar Jaiswal vs. Sunny Singhal” pending
adjudication before the learned District Judge (Commercial Courts), North
District, Rohini Courts, Delhi, to the Court where the civil suit instituted by
the present petitioner being CS SCJ No. 61/2021, titled as “Sunny Singhal
vs. Robin Kumar Jaiswal” is pending.
5. Learned counsel for respondent submits that he has no objection if the
said civil suit instituted by the petitioner being CS SCJ 61/2021, which is
pending before the learned ASCJ, West District, Tis Hazari Courts, Delhi, is
transferred to the Court of learned District Judge, (Commercial Court), North
District, Rohini Courts, Delhi, where the said commercial suit filed on behalf
of the respondent being CS (Comm) No. 105/2021, titled as “Robin Kumar
Jaiswal vs. Sunny Singhal” is pending.
6. Learned counsel for the petitioner has no objection to the same.
7. In view of the above, civil suit being CS SCJ 61/2021 titled as “Sunny
Singhal vs. Robin Kumar Jaiswal” pending before the learned ASCJ, West
District, Tis Hazari Courts, Delhi, is transferred to the Court of learned
District Judge, (Commercial Court), North District, Rohini Courts, Delhi,
where the commercial suit instituted on behalf of the respondent being CS
(Comm) No. 105/2021, titled as “Robin Kumar Jaiswal vs. Sunny Singhal”
is pending. The said suit shall proceed from the stage it is being transferred,
and the same shall be tried along with CS(COMM) 105/2021.

8. Let the records of civil suit being CS SCJ 61/2021 be transferred to the
learned Transferee Court, within a period of 10 days.
9. Parties are directed to appear before the learned Transferee Court,
accordingly.
10. Copy of the order be sent to learned District Judge (Commercial
Courts), North District, Rohini Courts, Delhi, as well as learned ASCJ, West
District, Tis Hazari Courts, Delhi, for necessary information and compliance.
11. In view of above, the present petition is disposed of.
12. Pending application(s), if any, also stands disposed of.
13. Order be uploaded on the website of this Court, forthwith.
