Learned counsel Ms. R. D. Mozumdar is present for the Insurance Company,
learned counsel Mr. M. Talukdar is present for respondent Nos. 1 to 5 and
learned Senior Counsel Mr. S. Dutta is present for respondent Nos. 6, 7 & 9.
It is submitted by the learned Senior Counsel that the respondent No. 8 has
passed way and it is clearly mentioned in the evidence of Rajani Paul as CW2 in
MAC Case No. 1594/2010 that one of his nephews i.e., Raju Paul has committed
suicide. It is also submitted that his name may be struck off.
I have considered the submission at the Bar that this case may proceed for
hearing, as other family members are already present, and the question of
impleading legal heirs of Raju Paul does not arise.
As the pleadings are complete and the Trial Court Records are before us, list
this matter for hearing on 14.05.2026.
