Heard learned counsel for the petitioner and learned
A.P.P. for the State.
2. The petitioner apprehends his arrest in connection
with Sahebpur Kamal P.S. Case No. 183 of 2023, instituted
under Sections 341, 323, 504, 307, 379 and 34 of the Indian
Penal Code.
3. As per the prosecution case, accused persons
including the petitioner stopped the informant and asked the
money and when the informant denied the same, he was
assaulted causing injury to him. Allegation against the petitioner
is that he had given fist blow on the nose of the informant.
4. Learned counsel for the petitioner submits that

petitioner is innocent and has falsely been implicated in this
case due to land dispute between the parties. There was no arms
in possession of the petitioner and the allegation is only that he
had given fist blow which shows that Section 307 I.P.C. is not
made out. There is delay of 17 days in lodging the F.I.R. without
any plausible explanation. The injury on the injured is simple in
nature. Petitioner has no criminal antecedent. He undertakes to
co-operate in the investigation and trial. Other co-accused,
namely Chandi Yadav has already been granted anticipatory bail
by a Co-ordinate Bench of this Court, vide order dated
19.12.2023 passed in Cr. Misc. No. 76134 of 2023.
5. Learned A.P.P. for the State opposes the prayer for
anticipatory bail and submits that the allegation against the
petitioner is specific and the allegation against co-accused
Chandi Yadav, who has been granted anticipatory bail, is that he
was the order giver.
6. Considering the facts and circumstances of the
case, submission of learned counsel for the parties, nature of
injury and clean antecedent of the petitioner, in the event of
arrest or surrender before the Court below within six weeks
from today, the petitioner be released on bail upon furnishing
bail bonds of Rs. 10,000/- (ten thousand) with two sureties of
Patna High Court CR. MISC. No.18951 of 2026(2) dt.18-04-2026

the like amount each to the satisfaction of learned Additional
Chief Judicial Magistrate IV, Begusarai in connection with
Sahebpur Kamal P.S. Case No. 183 of 2023, subject to the
conditions laid down in Section 482 (2) of the Bharatiya Nagrik
Suraksha Sanhita (B.N.S.S.), 2023.
