[1] Heard Mr. K. Roshan, learned counsel for the petitioner.

[2] The petitioner namely, Mr. N. Sanatomba Singh who is working
as Sub-Inspector Pharma in Central Reserve Police Force (CRPF) and presently
posted at Composite Hospital, Imphal (CH, Imphal). The petitioner is aggrieved
by order dated 27.02.2026 passed by the Deputy Director (Medical) DTE
transferring under summer chain transfer, 2026 from CH, Imphal to 099 RAF.
Vide order dated 30.01.2026 passed by the Dy. Director (Medical) DTE, the
petitioner who is a S.I. Pharma was transferred from CH, Imphal to RTC-Srinagar
and by another order dated 30.01.2026, his wife namely, Kh. Jiteshwari Devi
who is a S.I. Pharma was also transferred from 109-BN to CH-HYD. The petitioner
submitted a representation dated 31.01.2026 to the IG Director Medical, Medical
Directorate, New Delhi and after his representation, the respondent issued
another transfer order dated 27.02.2026 transferring from CH, Imphal to 099
RAF. The petitioner submitted another representation dated 02.03.2026 against
the second transfer order dated 27.02.2026 and the same was returned to the
petitioner with an advice that the petitioner may approach Director General,
CRPF.

[3] The learned counsel for the petitioner submits that the petitioner
was promoted vide order dated 07.03.2025 to S.I. Pharma and he has been
posted in CH, Imphal. As per standing order 04/2022 dated 27.09.2022 at ‘Para
no. 8(a)(i)’, the tenure for personnel like the petitioner should be 3(three) years
and by the impugned order dated 27.02.2026, the petitioner has been
transferred before the completion of 3(three) years tenure from the date of
posting on promotion i.e. 01.04.2026 and also by ‘para no. 7(iv)’ the couple
working in the CRPF are to be considered for posting to the same place or to a
nearby station. The learned counsel for the petitioner also draws the attention
of this Court to the Office Memorandum dated 24.11.2022 issued by Department
of Personnel and Training (DoPT), Govt. of India, especially ‘clause B(2)((iii)’
stipulates that spouses may be posted at the same station.

[4] On the other hand, Mr. S. Vijayanand Sharma, learned Sr. PCCG
for the respondents submits that earlier transfer order dated 30.01.2026 to RTC
Srinagar was modified on his representation to 099 RAF, Secunderabad, which
is the nearest station adjacent to petitioner wife and the same is in terms of the
standing order 04/2022 dated 27.09.2022 and O.M. dated 24.11.2022 issued by
DoPT, Govt. of India.

[5] Mr. K. Roshan, learned counsel for the petitioner submits that at
this stage, it will suffice for the petitioner, if the posting can be considered at the
same station of his wife. The respondents may consider this plea without going
to the merit of the case.

[6] The learned Sr. PCCG for the respondents submits that he may
be given 1(one) week time for taking instructions in this regard.

[7]             List these cases on 22.04.2026 in motion column.

[8]             Status quo shall be maintained till the next date.

[9]             Furnish a copy of this order to the learned counsel appearing for

the parties in the course of the day by whatsapp or any other available mode.
