ORDER
1. They are heard. Perused the case diary / challan papers.
2. This is third bail application filed by the applicant under Section
483 of Bhartiya Nagrik Suraksha Sanhita, 2023 (439 of Cr.P.C.) as he/she is
implicated in connection with Crime No.175/2025 registered at Police
Station Barwah, District Khargone (MP) for offence punishable under
Section 132, 121(1), 221, 296, 351(3), 324(4), 3(5), 121(2) of BNS, 2023.
The applicant is in custody since 03/04/2025.
3. His first application M.Cr.C. No.31377/2025 was dismissed by this
Court on merits on 08/08/2025 with liberty to renew prayer after the
complainant Aayush is examined in the trial Court, whereas his second bail
application M.Cr.C. No.46659/2025 was also dismissed on 06/11/2025 with
further liberty to renew prayer if the trial is not concluded within a further
period of six months.

4. Counsel for the applicant has submitted that the applicant has
completed around more than 9 months and he is also closed to completed the
minimum sentence of one year as he is lodged in jail since 03/04/2025 and
final conclusion of the trial is likely to take sufficient long time, therefore, it
is prayed that the application be allowed and the applicant be released on
bail.
5. Counsel for the respondent / State, on the other hand has opposed
the prayer and it is submitted that the CCTV footage of the incident is also
available and the complainant was a policeman and was managing the traffic
when the incident took place and thus, no case for grant of bail is made out.
6. Having considered the rival submissions and perusal of the case
diary, and also considering the earlier order of dismissal, this Court does not
find it to be a fit case for grant of bail on account of the brazen assault made
by the applicant in broad daylight on police personnel for no apparent
reason.
7. M.Cr.C. is accordingly dismissed. However, the applicant can renew
his prayer as earlier directed to him.
