This miscellaneous appeal has been filed by the appellants/claimants
under Section 173(1) of the Motor Vehicles Act, 1988, being aggrieved by
the Award dated 09.05.2019 passed by 7th Member, Motor Accident Claims
Tribunal, District- Gwalior (M.P.) (hereinafter referred to as “the Claims
Tribunal”) in Claim Case No.1008/2017, on the ground of inadequacy of
compensation and seeking enhancement thereof as well as on the ground of
exoneration of Insurance Company from liability.
2. The date of accident and issue of negligence are not in dispute. The
findings recorded by the Claims Tribunal in this regard are not in question.
