COMMON JUDGMENT:
This Criminal Revision Case has been filed under Sections 438 and 442
of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’)
seeking to challenge the Judgment, dated 25.02.2022 passed in Crl.A.No.107
of 2019 on the file of the learned I Additional District and Sessions Judge,
Prakasam District at Ongole, confirming the Judgment passed by the learned
Judicial Magistrate of First Class, Kanigiri dated 22.04.2019 in C.C.No.58 of
2016.
2. Heard the learned counsel for the petitioner, learned Assistant Public
Prosecutor for the State and learned counsel for the respondent No.1.
3. The petitioner/accused and respondent No.1/complainant are present.
They have compromised the matter. They filed I.A.No.2 of 2026 to
compromise the matter.
4. The respondent No.1/complainant is permitted to compromise the
matter with the petitioner/accused under Section 320(6) of Criminal Procedure
Code (for short ‘the Cr.P.C.’), read with Section 147 of Negotiable Instruments
Act.

5. In that view of the matter, I.A.No.2 of 2026 is allowed. Consequently,
the Criminal Revision Case is allowed in terms of compromise. The
petitioner/accused is directed to pay an amount of Rs.10,000/- towards costs
to the District Legal Services Authority, Prakasam District and furnish the
receipt of such payment to the Registry by 10.04.2026. In default, this Criminal
Revision Case stands dismissed. The Member Secretary, District Legal
Services Authority, Prakasam District is directed to spend this amount for the
welfare of the children in the Government Home to provide any amenity or
purchase clothes or books or any other things to attend their needs. The
Registry is directed to record the compliance.
6. Accordingly, the petitioner is acquitted under Section 320(8) of ‘the
Cr.P.C.’. The Judgment, dated 25.02.2022 passed in Crl.A.No.107 of 2019 on
the file of the learned I Additional District and Sessions Judge, Prakasam
District at Ongole, confirming the Judgment passed by the learned Judicial
Magistrate of First Class, Kanigiri dated 22.04.2019 in C.C.No.58 of 2016 are
set aside subject to payment of costs.
Consequently, miscellaneous applications pending, if any, shall stand
closed.
