    01. The petitioner through the medium of the instant petition
    has challenged the order dated 28th May, 2024 passed by the
    learned Principal Sessions Judge, Anantnag in a revision titled
    Balbir Singh vs Gurmeet Kour.” The petitioner has also challenged
    the order dated 25th July, 2017 passed by the Court of learned
    Special Mobile Magistrate, Anantnag in File No. 199/Meem.

    02. From a bare perusal of the order passed by the learned
    Special Mobile Magistrate, Anantnag, it is apparent that the shop
    in question has been ordered to be attached and stock lying
    therein worth Rs. 52,000/- has been directed to be sold and the
    sale proceeds thereof have been directed to be deposited with the
    court below and for compliance of the said order, warrant to
    enforce the attachment has been issued and entrusted to the
    Station House Officer Police Station, Anantnag for carrying into
    effect the said attachment order.

    03. The order dated 25th July, 2017 so passed by the learned
    Special Mobile Magistrate, Anantnag came to be challenged by the
    petitioner by way of a revision before the learned Principal
    Sessions Judge, Anantnag, however, the said revision came to be
    dismissed by the learned Revisional Court by virtue of a detailed
    judgment dated 24th May, 2024 and the order passed by the Court
    of learned Special Mobile Magistrate, Anantnag has been upheld.
    Being aggrieved by the order passed by the learned Principal
    Sessions Judge, Anantnag, the petitioner has preferred the instant
    petition. The primary ground which has been raised in the instant
    petition is that the order dated 25th July, 2017 passed by the
    learned court below would not stand the test of law, more
    specifically for the reason that in the basic proceedings filed by the
    respondent against the son of the petitioner, the petitioner herein
    was not arrayed as a party and the proceedings for grant of
    maintenance had been initiated against Gurmeet Singh (son of the
    petitioner) in his individual capacity.

    04. With a view to clinch the controversy in question, this
    Court deems it proper to array “Gurmeet Singh S/o Balbir Singh R/o
    Bongund Hatmurrah, Anantnag” as party respondent in the instant
    petition, as he was also party before the learned trial court.
    Ordered accordingly.

    05. Registry to update the cause title and issue notice to
    Gurmeet Singh S/o Balbir Singh R/o Bongund Hatmurrah,
    Anantnag for his personal appearance in the matter on the next
    date of hearing, so that the issue which has been projected in this
    petition is resolved once for all.

    06. In addition, the petitioner is also directed to take steps for
    service of notice upon the newly added respondent.

    07. List again on 28th April, 2026.
