Delhi HC restrains Sanjay Dutt backed ‘Glenwalk Godfather’ whiskey launch amid trademark dispute

The Delhi High Court has granted interim relief to Devans Modern Breweries in its trademark suit against Cartel Bros Private Limited over ‘The Glenwalk Godfather Whiskey’, an entity backed by Sanjay Dutt.

The court has restrained new social media posts and sales via instructed retailers in Mumbai and Thane, Maharashtra till the next hearing.

In a single judge bench order of Justice Tushar Rao Gadela, the bench has directed the defendants to refrain from issuing any fresh promotional or social media communications in relation to the product under the “GODFATHER” mark until the next hearing.

“Defendant no.1 shall not release any new posts in respect of the afore-noted product on social media platforms till the next date of hearing,” the bench noted.

Devans has alleged that Cartel Bros had dishonestly adopted the mark “GODFATHER”, which is identical to its well-established and registered trademark used for its flagship beer brand.

Devans submitted that its “GODFATHER” mark enjoys significant reputation and goodwill in the Indian market, supported by multiple trademark registrations, and that the defendants’ use of the identical mark for whisky would amount to infringement and passing off.

Following submissions before the court, the defendants agreed to defer the commercial launch of their product under the impugned mark until the next date of hearing.

The court further specified that the defendant bears no responsibility for any additional dissemination of already-published advertisements, listings, or public domain information, provided it does not originate from the defendant or its distributors/retailers.

The suit is registered and the matter has been listed before the court on April 10, 2026.
