ORDER
1] Heard finally with the consent of the parties.
2] This petition has been filed by the petitioners under Section 482 of
Cr.P.C./Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 for
quashment of FIR bearing Crime No.1068/2022 for the offence punishable
under Sections 498-A, 323, 506, 34 of IPC and Section 3, 4 of Dowry
Prohibition Act, 1961 registered at Police Station Banganga, District Indore
and criminal case and other consequential proceedings.
3] Counsel for the petitioners and respondent No.2, at the outset have
submitted that the case is on the initial stage, and the petitioners and
respondent No.2 have already settled the matter out of the Court. An
application I.A. No.1184/2026 under Section 338(2) of BNSS for no

objection has also been filed by the complainant. It is submitted that no
purpose would be served to keep the matter pending, the result of which is
already decided, and in such circumstances, the petition may be allowed.
4] Counsel for the respondent No.2 has submitted that he has no
objection if the petition is allowed, and on a query made by this Court to the
complainant/respondent No.2, who is also present in the Court, she has stated
that she has no objection if this petition is allowed.
5] Counsel for the respondent/State has submitted that appropriate order
may be passed.
6] Having considered rival submissions, perusal of the documents filed
on record including I.A. No.1184/2026 under Section 338(2) of BNSS filed
by the complainant, and further taking note of the fact that the parties have
compromised the matter voluntarily without any threat, inducement and
coercion, this Court has no hesitation to allow the present petition.
7] Accordingly, the petition is hereby allowed and the FIR bearing
Crime No.1068/2022 for the offence punishable under Sections 498-A, 323,
506, 34 of IPC and Section 3, 4 of Dowry Prohibition Act, 1961 registered at
Police Station Banganga, District Indore and all other consequential
proceedings arising out of the said crime number, are hereby quashed.
8] Accordingly, the petition stands allowed and disposed of.
