ORDER
This is the applicant’s first bail application under Section 482 of the
Bharatiya Nagarik Suraksha Sanhita,2023/under Section 438 of the
Cr.P.C.,1973, for grant of anticipatory bail as he/she is apprehending his/her
arrest in connection with Crime no.247/2025, registered at police station
Lasudiya, Indore(M.P.) for offence under Sections 420, 406, 465, 467,468,
471 and 120-B of the IPC.
2] The allegation against the applicant is of his involvement in the
aforesaid case of fraud by impersonation, as it is alleged that an agreement
was entered into between the complainant Narendra Kumar Maheshwari and
co-accused Kapil Goyal for sale of a plot in Vistara Township, however, the
aforesaid plot could not be sold to the complainant he was assured that a plot
at Babji Nagar can be sold to him which belongs to Prabal Patodi and it is

alleged that the applicant impersonated as Prabal Patodi.
3] Counsel for the applicant has submitted that there are are no
criminal antecedents of the applicant and he was acting on behalf of the co-
accused Kapil Goyal only. It is also submitted that Kapil Goyal has already
been granted bail by the trial court itself and no purpose would be served to
arrest the applicant as the charge sheet has already been filed. The applicant
has also filed on record a copy of the complaint dated 25.05.2024 made to
the police regarding some other fraud committed by co-accused Kapil Goyal
with one Aslam Khan wherein the applicant had acted as a broker.
4] Counsel for the respondent/State, on the other hand, has opposed
the prayer.
5] Heard. Having considered the rival submissions, perusal of the
case diary, it is apparent that the applicant entered into an agreement with the
complainant Narendra Kumar Maheshwari by impersonating as Prabal
Patodi, the document regarding which has also been filed by the applicant on
record. So far as the complaint filed by the applicant on 25.05.2024 is
concerned, it is of no avail to him as it does not relate to the present case.
6] In such circumstances, this Court does not find it to be a fit case for
grant of anticipatory bail, as the custodial interrogation would be necessary.
7] Accordingly, the M.Cr.C. stands dismissed.
