UPON hearing the counsel the Court made the following
O R D E R
1. Rajasthan Public Service Commission, Ajmer 1 has applied for modification
of the order passed by us yesterday, i.e., 2nd April, 2026, whereby we allowed a
miscellaneous application of the opposite party, Surajmal Meena 2, permitting

him to participate in the recruitment examination scheduled on 5 th April, 2026,
provisionally, and without creating any equity. It was also directed that other
similarly placed job aspirants like Meena, willing to participate, may also be
provisionally permitted.
2. We have heard learned counsel appearing for the RPSC as well as learned
counsel appearing for Meena. Apart from Meena, no other job aspirant
approached this Court seeking permission. In compliance with the order of this
Court, admit card has been issued in favour of Meena. On appreciation of the
logistical problems and difficulties projected in the present application that are
likely to arise if all other job aspirants have to be issued admit cards within such
a short time, we are of the considered opinion that the said order dated 2 nd
April, 2026 ought to be suitably modified. Accordingly, we direct deletion of
paragraphs 5 and 6 thereof. We also modify paragraph 7 by observing that it
shall be restricted only to Meena and not to any other job aspirant.
3. Since the Division Bench of the High Court of Rajasthan, Bench at Jaipur,
is yet to pronounce its judgment on the appeals pending before it, we also
observe that this order is without prejudice to the rights and contentions of the
parties before the said Division Bench. In the event the Division Bench directs
RPSC to hold a further examination, any private party may reap the benefit
thereof while any party aggrieved thereby may approach the appropriate court
in accordance with law.
4. The miscellaneous application stands disposed of, on the above terms.
5. Pending application(s), if any, shall also stand disposed of.
