01.     1.     Heard learned counsel for the respective parties.

2. Instant petition under Section 482 BNSS is filed
seeking pre-arrest bail of the petitioner in connection with
Kantamal P.S. Case No. 296 of 2025 arising out of Special
Case No.26 of 2026(NDPS) pending in the court of learned
Additional Sessions Judge-cum-Special Judge, Kantamal on the
grounds stated.

3. Perused the FIR as at Annexure-1. It is claimed that the
petitioner was engaged in cleaning grass from the field used for
large scale cultivation and hence, should be directed to go on
bail but objecting to the same, learned counsel for the State
would submit that he has one more antecedent of similar
nature. Considering the above facts and submissions of learned
counsel for the respective parties, this Court, in view of the

antecedent of the petitioner, is not inclined to allow him to go
on bail.

4. Accordingly, it is ordered.

5. In the result, the ABLAPL is disposed of. However,
granting the liberty to the petitioner to surrender before the
learned court below and in case the same is complied with
within a fortnight from today and an application for bail is
received from him, learned Additional Sessions Judge-cum-
Special Judge, Kantamal shall consider it in connection with
Special Case No.26 of 2026(NDPS) and dispose it of. taking
into account the materials on record and the plea as to absence
of bar under Section 37 of the NDPS Act.

6. Issue urgent certified copy of this order as per rules.
