04/ 30.03.2026: This bail application has been filed by the petitioner under Sections
483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail
as he is in custody for allegedly committing offence punishable under
111(4), 317(5) and 61(2) Bharatiya Nyaya Sanhita and Section 25(1-B)(a),
26(2) and 35 of the Arms Act.
2. Heard, learned counsel for the petitioner, learned counsel for the
State and have also gone through the impugned order.
3. Learned AddI. P.P. opposes the prayer for bail.
4. Prosecution case is that the police got information that the gang of
Prince Khan and Saifi @ Major was planning to commit crime. A
motorcycle coming from Tetulmari was signaled to stopped. The riders
attempted to flee, but he was apprehended while the pillion rider
escaped. The rider revealed the name of the pillion rider and disclosed
that both of them are working for Prince Khan and involved in
threatening businessmen and extorting money.
5. Though the petitioner is named in the confessional statement of the
co-accused, but that except this case there are five other criminal cases
pending against this petitioner, which are as under:-
1.Bankmore P.S. case No.138 of 2023, dated 18.06.2023, Sections
385/386/387/504/506/120B/34 of IPC and 34/25(1-B)/26/35 of the Arms Act.
2. Bankmore P.S. case No.108 of 2022, dated 08.05.2022, Sections
341/385/387/504/506/120B of IPC and 27 of the Arms Act.
3. Bankmore P.S. case No.211 of 2023, dated 05.09.2023, Sections 411/120B of
IPC and 25(1-B)A/26/35 of the Arms Act.
4. Bankmore P.S. case No.71 of 2022, dated 29.03.2022, Sections
307/387/427/120B of IPC and 27 of the Arms Act.
5. Rajganj P.S. case No. 80 of 2025, dated 10.09.2025, Sections
308(4)/308(5)/109/351(2)/352/61(2)/111/3(5) of BNS and 27 of the Arms Act.
6. Considering the aforesaid fact, at this stage, I am not inclined to
grant privilege of bail to the petitioner. Accordingly, the prayer for bail
of the petitioner in connection with Rajganj P.S. Case No.87 of 2025,
pending in the Court of learned C.J.M., Dhanbad, stands rejected.
7. Accordingly, this bail application is dismissed.
