read with paragraph 38 of the plaint, leave granted under Clause 12 of
the Letters Patent, 1865 to institute the suit.
In view of the averments made in paragraphs 33, 34 read with
paragraphs 40 to 42 of the plaint, requirement of pre-litigation mediation
as provided under Section 12A of the Commercial Courts Act, 2015
stands dispensed with as the plaintiff has contemplated urgent interim
order.
