[1] Read this conjunction with and in continuation of earlier

proceedings made in the previous listing, more particularly proceedings made

in the listing on 04.02.2026 which reads as follows:

‘[1] At the outset it is made clear that Registry ought not to have listed
the captioned matter under the cause list caption ‘SERVICE NOT
COMPLETED’, the reason is, notice has not been ordered as yet.
Registry to do a course correction in this regard from next listing.

[2] Be that as it may, read this in conjunction with and in continuation
of earlier proceedings made in the previous listing on 19.11.2025 which
reads as follows:

‘[1] In the captioned Miscellaneous Case (MC),
Condonation of Delay (CoD) is the prayer. 92 days delay in
filing a statutory appeal under Section 21 of ‘the National
Investigation Agency Act, 2008
(34 of 2008)’ (hereinafter, ‘NIA
Act
‘ for the sake of brevity) is the prayer.
[2] Mr. W. Niranjit, learned State counsel for
applicant, submits that in the light of first proviso to Sub-Section
5
of Section 21 of NIA Act, the issue as to whether delay beyond
90 days qua statutory appeals under Section 21 of NIA Act can
be entertained is a question which the Hon’ble Supreme Court is
seized of.

[3] Learned State counsel requests for time to
ascertain the correct position in the Hon’ble Supreme Court and
as to whether any verdict has been returned by the Hon’ble
Supreme Court and revert to this Court. Request of learned State
counsel acceded to.

       [4]            List on 04.02.2026.'

[3]    Adverting to earlier proceedings, Mr. W. Niranjit, learned State

counsel has placed before us an order dated 11.12.2025 made by
Hon’ble Supreme Court. In this order of Hon’ble Supreme Court, there is
a reference to earlier order dated 20.05.2025. Learned State counsel
requested for further time to acquaint himself with the earlier order and
revert to this Court. Learned State counsel also requested for time to
ascertain if only appeals which have already been numbered and taken
on file stand covered or whether it would apply to appeals which are yet
to be numbered owing to pendency of Condonation of Delay (CoD)
applications.

[4] Request of learned State counsel acceded to.

[5] In the next listing, Registry to list under a suitable cause list
caption.

 [2]          Adverting to afore-referred earlier proceedings, Mr. W. Niranjit

Singh, learned State counsel for applicant submits that the case is scheduled

to be listed in Hon’ble Supreme Court on 07.05.2026 and requests for listing

of captioned matter after that date. Request acceded to.
